Orer.am-ը Պետական վերահսկողական ծառայության պետի պաշտոնը զբաղեցրած Դավիթ Սանասարյանից հետաքրքվեց, թե դիտարկում ունի արդյոք, թե բարձրաստիճան պաշտոնյաների հանդեպ հարուցված քրեական գործերի ժամանակ ինչու է մի դեպքում ընտրվում կալանավորումը և այն հիմնավորվում նախաքննության վրա չազդելու ապահովություն, իսկ մեկ այլ բարձրաստիճան պաշտոնյայի դեպքում ընտրվում ստորագրությունը չհեռանալու մասին, երբ բացառված չէ, որ այդ դեպքում նույնպես կարող է նախաքննական մարմնի վրա ճնշում գործադրելու վտանգ լինել: Եվ արդյո՞ք դա ընտրովի վերաբերմունք չէ, տարբեր բարձրաստիճան պաշտոնատար անձնանց հանդեպ:

Հարցին ի պատասխան, պարոն Սանասարյանն ասաց, որ հնարավոր չէ ասել, թե ինչու է մի դեպքում խափանման միջոցը կալանավորումն ընտրվում, իսկ մյուս դեպքում՝ չհեռանալու մասին ստորագրությունը: Բացի այդ, միշտ չէ, որ միանման դեպքերում հարկավոր է նմանատիպ որոշում կայացնել:

ՊՎԾ նախկին պետի փաստաբան Արսեն Սարդարյանն էլ նշեց, որ պաշտպանական կողմը չի կարող գնահատական տալ, թե որևէ պաշտոնյայի խափանման միջոցի ընտրության հարցն իրավաչա՞փ է, թե՞ ոչ: Ինչ վերաբերում է հարցի քաղաքականացմանն ու ընդունված ստանդարտների կիրառմանը, ապա իրականում ստանդարտներ չկան, քանի որ յուրաքանչյուր գործի ժամանակ խափանման միջոցի ընտրության հարցը կարող է տարբեր հանգամանքներով պայմանավորված լինել:

«Այդ թվում առաջադրված մեղադրանքի հանգամանքը և դրա ծանրությունը: Այսինքն, կարող է պարոն Սանասարյանին միջին ծանրության հանցագործության համար է մեղադրանք առաջադրվել, իսկ մյուսին առանձնապես ծանր հանցագործության համար են մեղադրանք առաջադրել: Բացի այդ, պարոն Սանասարյանին մեղադրանք առաջադրողները հասկանում են, որ այն շատ թույլ է և ըստ էության հեռանկար չունի: Ուստի, հավանաբար, մտածում են, որ ամեն դեպքում մեղադրանք առաջադրեն, որպեսզի ցույց տան, որ կաշկանդված չեն նրա զաբաղեցրած բարձր պաշտոնով:

Բայցի այդ նախաքննական մարմինը հասկանում է, որ կալանքի համար պետք է ծանրակշիռ հիմքեր լինեն, իսկ եթե դրա ապօրինությունը հաստատվի, ապա պետությունը պետք է դրա դիմաց փոխհատուցում տա: Ես կարծում եմ, այդ իսկ պատճառով էլ իրավասու մարմինները չեն էլ փորձել դրա տակ մտնել: Բայց ես չեմ ուզում ողջունել նրանց այդ քայլը: Սա այնպիսի գործ է, որ պարոն Սանասարյանին մեղադրանք առաջադրելն արդեն իսկ սխալ է եղել: Եվ դրանից հետո ասել, որ մեղադրանք են առաջադրել, բայց չեն կալանավորել, որովհետև մեր նկատմամբ բարեհաճ են գտնվել, այդպես չէ: Ես չգիտեմ, թե դա ինչով է պայմանավորված եղել, բայց նրանք մեր նկատմամբ սխալ են վարվում»,- ասաց Ա.Սարդարյանը:
