Այսօր, ԱԺ նիստի ժամանակ ՀՀ դատախազ Արթուր Դավթյանը պատգամավորներին է ներկայացնում 2018 թվականի գործունեությունը: Նիստի ժամանակ ՀՀ գլխավոր դատախազ Արթուր Դավթյանը պատասխանելով ԱԺ «Լուսավոր Հայաստան» խմբակցության պատգամավոր Արկադի Խաչատրյանի՝ ապօրինի հարստացման և փողերի լվացման մասին հարցին, թե՝ քանի գործ կա հարուցված և ներկայում ինչ պատկեր ունենք, նշեց, որ երկու հանցակազմերն էլ մեր իրավակիրառ պրակտիկայի համար մեծ հաշվով նորություններ են, իսկ իրավական ձևակերպումները վիճահարույց հարցեր են պարունակում: Այդուհանդերձ, վերջին մեկ ու կես տարվա ընթացքում գործում է ապօրինի հարստացման մասին քրեական հոդվածը, որի շրջանակներում այս պահին 5 անձի հանդեպ քրեական հետապնդում է իրականացվում:

«Փողերի լվացման առումով, 2018 թվականին 2017 թվականի համեմատ ակտիվացում ունենք: Եվ եթե չեմ սխալվում, եթե 17-ին փողերի լվացման հարցով որևէ գործ չունեինք հարուցված, ապա 18 թվականին ունեցել ենք այս հոդվածով հարուցված 8 կամ 9 քրեական գործ: Բայց, խնդիրն այն է, որ, ի սկզբանե, ոչ թե փողերի լվացման հարցով են գործերը հաուցվում, այլ՝ քրեական գործերի ընթացքում, երբ պարզվում է, որ հանցավոր ճանապարհով ձեռք բերված գույքը հետագայում փորձ է արվել օրինականացնել: Այդ դեպքում նրա մեղադրանքի մեջ ընդգրկվում է նաև փողերի լվացման հանցակազմը»,- ասաց Ա. Դավթյանը:

ՀՀ դատախազը հույս հայտնեց, որ կոռուպցիոն հանցագործությունների բացահայտմանը զուգահեռ կավելանան նաև փողերի լվացման դեպքերի բացահայտման ցուցանիշները, իսկ ապօրինի հարստացման մասով որևէ գնահատական հնչեցնել նա չցանկացավ:

Պատգամավորի հետաքրքվեց, թե ինչպես է պատահում, որ փողերի լվացման մասով գործարքներ, այնուամենայնիվ, բացահայտնվում են, սակայն այդ մասով կամ մեղադրական դատավճիռներ չեն կայացվում, կամ հատուկենտ են դեպքերում են կայացվում: Ա. Խաչատրյանը ՀՀ դատախազից փորձեց ճշտել նաև, թե կարո՞ղ է դրա պատճառը մասնագիտական կարողությունների պակասը լինել, թե՞ առհասարակ Հայաստանում նման հանցատեսակ չկա:

«Մինչ այժմ, հատկապես փողերի լվացման առումով մեր իրավակիրառ պրակտիկայում միջազգային իրավական մոտեցումների համապատասխան ճիշտ իրավական տալու խնդիր կա: Այդ իսկ պատճառով, իրավակիրառ պրակտիկան դեռևս լիարժեք հունի մեջ չի մտել: Սա ավանդական հանցատեսակ չէ և բացահայտման հարցում բարդություններ կան: Առավել լուրջ են բարդությունները, երբ խոսքը վերաբերում է իրավական գնահատական տալուն»,- ասաց Ա. Դավթյանը:
