Անցումային արդարադատության վերաբերյալ ԼՈՒՐԵՐ.com- ը զրուցեց Մովսես Արիստակեսյանի հետ։

-Պարոն Արիստակեսյան, ինչպիսի՞ վերաբերմունք ունեք հարցի վերաբերյալ։

-Կարծում եմ՝ այս քննարկումը համահունչ է թավշյա հեղափոխության արժեքներին եւ այդ արժեքներին համահունչ էլ պետք է լինեն գործիքները, որոնք պիտի իրականացնի անցումային արդարադատությունը։ Պետք է հայաստանյան հասարակության, սերունդների հաշտեցում լինի։ Չէ որ բոլոր իշխանավորները անկախությունից ի վեր նախագահներից մինչեւ պաշտոնյա բոլորի ձեռքին եղել է օրենքի ուժը, քաղաքացիների իրավունքները ոտնահարելու, այդ գործիքն օգտագործելով նաեւ հարստահարելու, հարստանալու եւ կեղեքելու Հայաստանի ժողովրդին։ Հիմա հաշտեցման գործիքներ ենք առաջարկում, որ իրականացվի արդարադատություն, ապացուցողական հիմք հանդիսացող եւ արժանահավատ տվյալների հիման վրա, եւ շատ կարեւոր է որ այդ գործընթացին ներգրավվեն քաղաքացիական հասարակության ներկայացուցիչները։ Պետք է վերադարձնել 30 մլրդից ավելի գողացած ակտիվները, եւ եթե իրենք պատրաստակամ կլինեն, իրականացնել համաներում։ Բայց, այն ճարտարապետները, որոնք կառուցել են այդ համակարգը, պետք է անպայման քրեական պատասխանատվության ենթարկվեն՝ սկսած Ռոբերտ Քոչարյանից, Սերժ Սարգսյանից, ինչու ոչ նախորդ նախագահից, եթե ապացուցողական փաստեր լինեն։ «Արմենթել» ընկերության սեփականաշնորհումը ռազմավարական օբյեկտների օֆշորացման նախադրյալն էր։

-ԲԴԽ նախագահը հրաժարական տվեց, կարծիքներ կան, որ ներկայիս իշխանությունը սահմանդրական կարգը խախտելով ճնշում է գործադրում դատական համակարգի վրա, Դուք նման բան տեսնում ե՞ք։

-Բացարձակապես ոչ, հեղափոխության այս փուլը շատ կարեւոր է, որովհետեւ եթե իշխանության 2 թեւերը ժողովրդավարացվեցին, դատական համակարգը նույնպես պետք է փոխվի։ Արդա՞ր է արդյոք պաշտպանել մեկին, ում ժողովուրդը հանցագործ է համարում, երկրի ղեկավար է եղել։ Այն դատավորները, որոնք ջանք են թափում մեզնից գողացած փողերով շարունակել աշխատել՝ բարոյական չէ։ Հետեւապես, ի՞նչ է, ՍԴ նախագահն ո՞վ է եղել, այդ մարդը 1995 թվականի ընտրություններից սկսած օրվա իշխանությունների պատվերն է կատարել։ Ապօրինի կերպով օրենքների խախտումով ընտրվել էր ԲԴԽ նախագահ։

-Շատ մասնագետներ ասում են, որ գործընթացը ուշացած է։ Ուշացած համարում ե՞ք։

-Բացարձակ ոչ։ Կարեւորում եմ այս գործընթացը, այն պետք է լինի ամբողջական, արժանահավատ փաստերի վրա հիմնված, որպեսզի լինի հաշտեցում, որ «ես քեզ, հանիրավի, չեմ դատապարտում, ահա փաստերը, եթե կարող ես ապացուցիր, չես կարող, մենք քեզ կդատապարտենք»։
