2018 թվականի նոյեմբերի 1-ին ՀՀ Ազգային ժողովի կողմից ընդունվել է «Էրեբունի-Երևանի հիմնադրման 2800-ամյակի և Հայաստանի Առաջին Հանրապետության անկախության հռչակման 100-ամյակի կապակցությամբ քրեական գործերով համաներում հայտարարելու մասին» ՀՀ օրենքը:

ՀՀ ԱՆ քրեակատարողական հիմնարկներում և մարմիններում հասարակական վերահսկողություն իրականացնող հասարակական դիտորդների խումբը 2019 թվականի մայիսի 8-ին դիմել է ՀՀ արդարադատության նախարարությանը՝ խնդրելով տեղեկատվություն տրամադրել այն մասին, թե համաներմամբ պատժի հետագա կրումից քանի անձ է ազատվել և նրացից քանիսն է ազատ արձակվելուց հետո կրկին հանցագործություն կատարել:

ՀՀ արդարադատության նախարարությունից տեղեկացրել են, որ 2019 թվականի ապրիլի 30-ի դրությամբ համաներմամբ պատժի հետագա կրումից ազատվել է 641 անձ: Սակայն տեղեկություններ չի փոխանցել այն մասին, թե նրանցից քանիսն է ազատ արձակվելուց հետո կրկին հանցագործություն կատարել՝ հիմնավորելով, որ նախարարությունը նման հաշվառում չի վարում:

Հաշվի առնելով այն հանգամանքը, որ ՀՀ արդարադատության նախարարությունը քրեակատարողական քաղաքականություն մշակող մարմինն է, և նախարարության կողմից նշված հարցի վերաբերյալ հաշվառմանիրականացումը կարևոր նշանակություն ունի՝ ճիշտ քաղաքականություն վարելու տեսանկյունից, Դիտորդների խումբը նախարարությանը առաջարկել է քննարկել պատժի հետագա կրումից ազատված անձանց կողմից կրկին հանցագործություն կատարելու վերաբերյալ տեղեկատվության հաշվառման նպատակահարմարությունը, ինչը նախարարության կողմից ընդունվել է ի գիտություն:

Այնուհետև Դիտորդների խումբը նույն հարցմամբ 2019 թվականի մայիսի 17-ին դիմել է ՀՀ ոստիկանությանը և դատախազությանը:ՀՀ ոստիկանության շտաբից պատասխանել են, որ 2019 թվականի մայիսի 22-ի դրությամբ համաներմամբ ազատված 80անձանց կողմից կատարվել են 165 հանցագործություններ:

Իսկ գլխավոր դատախազության կողմից 2019 թվականի հունիսի 6-ին տրամադրած տեղեկատվության համաձայն՝«Էրեբունի-Երևանի հիմնադրման 2800-ամյակի և Հայաստանի Առաջին Հանրապետության անկախության հռչակման 100-ամյակի կապակցությամբ քրեական գործերով համաներում հայտարարելու մասին» 2018 թվականի նոյեմբերի 1-ի ՀՕ-414-Նօրենքի կիրառմամբ մայիսի 17-ի դրությամբ ՀՀ ԱՆ քրեակատարողական հիմնարկներից ազատ է արձակվել 646դատապարտյալ, որոնցից 81-ը կրկին կատարել է նոր հանցագործություն:

Նույն oրենքի կիրառմամբ՝ մայիսի 17-ի դրությամբ քրեական հետապնդումը դադարեցվել է կալանավորված 3 մեղադրյալինկատմամբ, որոնցից 2-ը կրկին կատարել է նոր հանցագործություն:
