ԼՀԿ-ն առաջարկում է ՔԿՀ-ների ծառայողների լիազորությունների կասեցման ժամանակում պահպանել նրանց աշխատավարձը

ՀՀ ազգային ժողովի «Լուսավոր Հայաստան» խմբակցությունն առաջարկում է քրեակատարողական հիմնարկների ծառայողների աշխատավարձը լիազորությունների կասեցման ժամանակում պահպանել:  ԱԺ պետաիրավական հանձնաժողովում երկարատև քննարկումներից հետո պատգամավոր Տարոն Սիմոնյանը որոշեց Քրեակատարողական ծառայության մասին ՀՀ օրենքում փոփոխություններ կատարելու մասին օրենքի նախագծի քննարկումը հետաձգել մինչև երկու ամսով:

«Օրենսդրական նախաձեռնության կարիքն առաջացել է այն ժամանակ, երբ մեզ դիմել են բավականին մեծ թվով քրեակատարողական ծառայողներ, բարձրացրել են այն հարցը, որ ծառայողի լիազորությունների կասեցման ժամանակահատվածում նրանց աշխատավարձը չի պահպանվում: Մինչդեռ նման կարգավորումը տարածվում է իրավապահ համակարգի մի շարք ծառայողների` դատավորների, դատախազների, քննիչների համար: Եվ ՔԿՀ-ների աշխատողներն իրենց ևս համարում են իրավապահ համակարգի անբաժան մասն ու ցանկություն ունեն, որ նման կարգավորում տարածվի նաև իրենց նկատմամբ: Առաջարկում ենք օրենքի համապատասխան մասը շարադրել հետևյալ խմբագրությամբ` քրեակատարողական ծառայողի լիազորությունների կասեցման ժամանակահատվածում նրանց աշխատավարձը պահպանվում է»,-ներկայացրեց Տարոն Սիմոնյանը:

Գործող օրենսդրությամբ քրեակատարողական ծառայողի լիազորությունների` քրեական հետապնդում իրականացվելու հիմքով ծառայության կասեցման դեպքում նրանց աշխատավարձը վճարվում է մինչև երկու ամսվա համար, իսկ մնացած մասը վճարվում է անմեղության հիմքով քրեական հետապնդումը դադարեցնելու կամ արդարացման դատավճիռ կայացնելու դեպքում:

ՀՀ արդարադատության փոխնախարար Տիգրան Խաչիկյանը նշեց, որ գաղափարն առաջադիմական է և ուղղված է անձանց համար աշխատանքային իրավունքի ոլորտում լրացուցիչ իրավական երաշխիքների սահմանմանը: «Խնդիրը մոտեցումը, այն գաղափարական ուղղվածությունն է, որը մենք դնում ենք մեր առջև` նախատեսելու մեկ կոնկրետ կատեգորիայի անձանց համար նման սահմանափակումներ, թե նախատեսելու համար այդ սահմանափակումները որոշակի կարգավիճակում գտնվող բոլոր անձանց համար»,-նշեց նա:

Խաչիկյանը հիմնավորեց, թե ինչու է այսօր պայմանավորված քննիչների, դատախազների և դատավորների մասով այդպիսի կարգավորումների նախատեսումը: Նա նկատեց, որ դրանք յուրահատուկ դեր ունեն: «Այդ երեք կատեգորիաներն ուղղակիորեն նախատեսված են սահմանադրությամբ:Սահմանադրական կարգավորում ունեցող ուղղակիորեն մատնանշված սուբյեկտներ են և իրականացնում են իշխանության իրենց թևի գործառույթները, պետք է դրվի համարժեք տարբերակում նրանց և այլ ծառայողների միջև: Հետևաբար` այս անձանց  և այլ ծառայություն իրականացնողն անձանց դիտարկել նույն կարգավիճակում, համարում ենք խնդրահարույց»,-ասաց  նա ու նկատեց, որ ՔԿՀ ծառայողները հանրային ծառայողներ են, որոնց կարգավիճակն ուղղակիորեն նախատեսված չէ սահմանադրությամբ:

Նա նաև շեշտեց, որ ՔԿՀ ծառայողները զինվորական ծառայողներին հավասարեցված անձինք են: «Նախագծի կյանքի կոչման պարագայում կարող ենք բախվել այն իրողությանը, որ միևնույն կարգավիճակ ունեցող անձանց համար օրենսդրական ակտերով մատնանշված կլինեն իրենց կարգավիճակի միասնականության գաղափարից չբխող անհարկի տարբերակումներ, որը նպատակահարմար չէ»,-ասաց նա:

Երկարատև քննարկումներից հետո Խաչիկյանն ասաց, որ նախագիծն այդ տեսքով ընդունելը համարում են անընդունելի և վերահաստատում են ցանկացած ձևաչափով համագործակցելու հանձնառությունը: Նա նշեց, որ այն առաջարկը, որ երբ ծառայությունը կասեցվում է հանրային ծառայողի կամքից չկախված հանգամանքներում և կրում է անբարենպաստ հետևանքներ, պետք է օրենսդրական լուծում ստանա, շեշտեց` պատրաստ են արդյունավետ համագործակցության:
