ԲԴԽ–ն հայտարարություն է տարածել դատարանների նկատմամբ ճնշումների վերաբերյալ

Որոշ դատական գործընթացների կապակցությամբ դատական իշխանության նկատմամբ առկա են տարաբնույթ տրամադրություններ, ինչն ի զորու է վտանգել բարձր հանրային հեղինակություն ու վստահություն վայելող դատական իշխանության գաղափարի կյանքի կոչումը: Նման հայտարարությամբ է հանդես եկել Բարձրագույն դատական խորհուրդը.

ԲԴԽ–ի հայտարարության մեջ մասնավորապես ասվում է.

Բարձրագույն դատական խորհուրդն արձանագրում է, որ որոշ դատական գործընթացների կապակցությամբ դատական իշխանության նկատմամբ առկա են տարաբնույթ տրամադրություններ, ինչն օրինաչափ է: Մինչդեռ երբեմն դրանք միտումնավոր ուղղորդվում են և բերում ոչ բարենպաստ զարգացումների, ինչն ի զորու է վտանգել բարձր հանրային հեղինակություն ու վստահություն վայելող դատական իշխանության գաղափարի կյանքի կոչումը:

Այդ կապակցությամբ Բարձրագույն դատական խորհուրդը հարկ է համարում առանձնակի կարևորել`

ա/ հանրության մեծ վստահություն վայելող բարձրաստիճան պաշտոնատար անձանց կամ հանրային գործիչների կողմից դատարանների և դատավորների հասցեին հնչեցվող արտահայտություններում խիստ ընտրողականություն դրսևորելու անհրաժեշտությունը՝ որևէ կերպ թույլ չտալու համար նույնիսկ գնահատողական դատողությունների տիրույթում վիրավորական բնույթի ձևակերպումներ.

բ/ իրավաբանական համայնքի ներկայացուցիչների կողմից ցանկացած շահի պաշտպանության իրականացումը բացառապես մասնագիտական, էթիկայի ու բարեվարքության կանոնների խստագույնս պահպանմամբ և ոչ երբեք դատական իշխանությունը հեղինակազրկելու, դատավորի անձը վիրավորելու և դատարանը վարկաբեկելու հաշվին.

գ/ դատավորների՝ ցանկացած ներազդեցության կամ ճնշման փորձից, պատվի, արժանապատվության ու անվտանգության դեմ ցանկացած ոտնձգությունից զերծ լինելը: Նման փորձերը մնալու են ընդամենը փորձեր և զրոյական ազդեցություն են ունենալու դատարանում քննվող ցանկացած գործի ընթացքի վրա, իսկ այդպիսի յուրաքանչյուր դեպք կլինի Բարձրագույն դատական խորհրդի ուշադրության կենտրոնում, որը հաստատակամ է ձեռնարկելու օրենքով նախատեսված քայլեր դատավորների անկախության ապահովման համար:

Միաժամանակ Խորհուրդը խիստ կարևորում է հատկապես իրավաբանական համայնքի՝ փաստաբանների, իրավապաշտպանների, դատախազների, քննիչների, հասարակական-իրավական կազմակերպությունների, դատավորներից ոչ պակաս կարևոր դերակատարությունը մեր պետության արդարադատական ինստիտուտների կայացման ու զարգացման գործում: Ավելին, գտնում ենք, որ իրավաբանական համայնքը պետք է դատական իշխանության հետ հավասարապես կիսի պատասխանատվությունը հասարակության առաջ՝ վերջնարդյունքում բացառապես մասնագիտական չափանիշներով գործող, հասանելի, ընկալելի և հանրային բարձր վստահություն վայելող արդարադատական համակարգ ունենալու ճանապարհին, քանի որ, ի վերջո, դրա անաչառ գնահատողն ու հիմնական շահառուն Հայաստանի Հանրապետության ժողովուրդն է»։
