«Փաստ» օրաթերթը գրում է

Ինչպես հայտնի է, ՀՀ կառավարության նախաձեռնությամբ հանրային քննարկման է դրվել «Ապօրինի ծագում ունեցող գույքի բռնագանձման մասին» ՀՀ օրենքի նախագիծը։ 

Նախագծով նախատեսված է, որ օպերատիվ-հետախուզական տվյալների հիման վրա, որն, ի դեպ, հրապարակային չէ, ՀՀ դատախազությունը կարող է սկսել ենթադրաբար ապօրինի ծագում ունեցող գույքի բռնագանձման գործընթաց, ուսումնասիրություն, կարող է ստանալ դատարանի թույլտվությունը բանկային գաղտնիք ստանալու վերաբերյալ՝ ընդամենը հիմնավորելով, որ դա իրեն անհրաժեշտ է: 

Մասնագետների հավաստմամբ՝ տեղեկատվության ոչ հրապարակային լինելն այս դեպքում խնդրահարույց է նաև հանրային վստահության առումով, քանի որ անհասկանալի է, թե ինչպե՞ս է հանրությունն իմանալու` օպերատիվ տեղեկություններ կա՞ն, թե՞ չկան, կամ՝ ի՞նչ տեղեկություններ են դրանք:

Օդում կախված է մնում նաև այն հարցը, թե ինչպե՞ս է բողոքարկվելու ուսումնասիրության հիմքերի առկայությունը, թե՞ մարդն այլևս պաշտպանվելու իրավունք չունի: 

Թերթի զրուցակիցը, ով պրոֆեսիոնալ ֆինանսիստ է և բանկային գործի գիտակ, նշել է, որ այս նախագծով կոպտորեն խախտվում է մարդու մասնավոր իրավունքների պաշտպանությունը, և, ըստ էության, հակասահմանադրական օրենք է։ 

Թերթն ուսումնասիրության արդյունքում պարզել է նաև, որ հիշյալ օրինագիծն ուղղակիորեն ամբողջությամբ ոչնչացնում է սեփականության ինստիտուտը, իսկ եթե չկա սեփականության ինստիտուտ, նաև տնտեսություն չկա։ 

Տարբեր փորձագետներ անհանգստություն են հայտնում նաև այն առումով, որ այս օրինագծի ընդունումը կարող է ունենալ լուրջ քաղաքական հետևանքներ, քանի որ թիրախում հիմնականում կարող են հայտնվել իշխանություններին անհաճո անձինք:

 Ի դեպ, կարծիք կա, որ մի շարք այլ հարցերի թվում նաև այս օրենքի ընդունման հակասահմանադրականությունը քողարկելու համար են իշխանությունները ցանկանում «գրավել» ՍԴ-ն։
