Զինծառայությունից խուսափած անձինք չեն կարողանա գումարի դիմաց ազատվել քրեական պատասխանատվությունից

ՀՀ զինվորական դատախազությունը տեղեկացնում և զգուշացնում  է, որ 2019 թվականի դեկտեմբերի 31-ից հետո այլևս չի գործելու օրենսդրական այն իրավակարգավորումը, համաձայն որի այն քաղաքացիները, որոնց հանդեպ պարտադիր զինվորական ծառայությունից խուսափելու հիմքով հարուցված է քրեական հետապնդում, կարող են  օրենքով սահմանված չափով և կարգով ՀՀ պետական բյուջե գումար վճարելով ազատվել քրեական պատասխանատվությունից և կանգնել զինվորական հաշվառման: Այս մասին հայտնեցին ՀՀ գլխավոր դատախազության հանրային կապերի բաժնից:

«Սահմանված կարգի խախտմամբ պարտադիր զինվորական ծառայություն չանցած քաղաքացիների մասին» Հայաստանի Հանրապետության օրենքը տարածվում է օրենսդրության խախտմամբ պարտադիր զինվորական ծառայության չզորակոչված (զորակոչից խուսափած) ու 27 (պահեստազորի սպաների դեպքում՝ 35) տարին լրացած կամ մինչև 27 (35) տարին լրանալը օրենքով սահմանված պարտադիր զինվորական ծառայությունից ազատվելու կամ պարտադիր զինվորական ծառայության զորակոչից տարկետում ստանալու հիմքեր ձեռք բերած այն քաղաքացիների վրա, որոնց նկատմամբ պարտադիր զինվորական ծառայությունից խուսափելու հիմքով հարուցված է քրեական հետապնդում:

Նշված օրենքի համաձայն՝ սահմանված կարգի խախտմամբ պարտադիր զինվորական ծառայություն չանացած որոշակի խումբ անձանց հնարավորություն էր տրված օրենքով սահմանված չափով և կարգով ՀՀ պետական բյուջե գումար վճարելով չենթարկվել քրեական պատասխանատվության և կանգնել զինվորական հաշվառման։

ՀՀ ԱԺ կողմից «Սահմանված կարգի խախտմամբ պարտադիր զինվորական ծառայություն չանցած քաղաքացիների մասին» օրենքի գործողության ժամկետը պարբերաբար երկարացվում էր: Այդ նպատակով կատարված վերջին օրենսդրական փոփոխությամբ՝ ԱԺ-ի կողմից ընդունված 2019 թվականի մարտի 6-ին, օրենքը տարածվում է այն անձանց վրա, որոնց 27 (պահեստազորի սպաները՝ 35) տարին լրացել է մինչև 2019 թվականի մարտի 1-ը, իսկ օրենքի գործողության ժամկետ է սահմանվել մինչև 2019 թվականի դեկտեմբերի 31-ը։

Նկատի ունենալով, որ նշված օրենքի գործողության ժամկետ է սահմանվել մինչև 2019 թվականի դեկտեմբերի 31-ը և այն երկարաձգելու մասին նոր օրենք չի ընդունվել, ուստի նշված ժամկետի լրանալուց հետո վերոնշյալ կարգն այլևս չի գործելու և սահմանված կարգի խախտմամբ պարտադիր զինվորական ծառայություն չանցած քաղաքացիները չեն կարող այդ հիմքով ազատվել քրեական պատասխանատվությունից։
