ՀՀ արդարադատության նախարարությունը հայտարարություն է տարածել, որով հերքել է լրատվամիջոցներում տարածված տեղեկատվությունը, թե ՈՒԵՖԱ-ի մրցավարական կոմիտեի նախագահ և Իտալական մրցավարների ասոցիացիայի խորհրդատու Պյեռլուիջի Կոլինան Հայաստանից երեխա է որդեգրել հանցավոր ճանապարհով: Ներկայացնում ենք ՀՀ արդարադատության նախարարության հաղորդագրությունը.

«Վերջին ժամանակաշրջանում որոշ լրատվական միջոցներ, խախտելով Հայաստանի Հանրապետության Սահմանադրությամբ հռչակված անմեղության կանխավարկածը, իրենց հրապարակումներում կամ քննարկումներում իրենց թույլ են տալիս մեղադրել օտարերկրյա քաղաքացիներին այն հանցավոր արանքների մեջ, որոնց քննարկումը դեռևս գտնվում է իրավապահ մարմինների քրեական վարույթում:

Ընդ որում, լրատվական որոշ միջոցներ իրենց իրավունք են վերապահում ներկայացնել կոնկրետ անձանց անուններ՝ մեղսագրելով վերջիններիս հանցավոր արարքների կատարում՝ առանց դատարանի վճռի հրապարակման:

Ստեղծված իրավիճակը Արդարադատության նախարարությունը համարում է անթույլատրելի և բարոյական և իրավական տեսանկյունից:

Հիմք ընդունելով 2019 թվականի դեկտեմբերի 6-ին Հայաստանի լրատվության միջոցներով հրապարակված ֆուտբոլային նախկին մրցավար, ներկայում ՈՒԵՖԱ-ի մրցավարական կոմիտեի նախագահ և Իտալական մրցավարների ասոցիացիայի խորհրդատու Պյեռլուիջի Կոլինայի վերաբերյալ հայտարարությունը՝ առ այն որ վերջինս երեխա է որդեգրել Հայաստանի Հանրապետությունից և այն էլ հանցավոր ճանապարհով, պաշտոնապես տեղեկացնում ենք.

Արդարադատության նախարարությունը երբևէ Իտալիայի Հանրապետության կենտրոնական մարմնից չի ստացել Պյեռլուիջի Կոլինայի դիմումը Հայաստանի Հանրապետության քաղաքացի հանդիսացող երեխա որդեգրելու մտադրությամբ: «Պյեռլուիջի Կոլինա» անուն, ազգանունով որևէ Իտալիայի քաղաքացի չի որդեգրել Հայաստանի Հանրապետության քաղաքացի հանդիսացող երեխա:

Նման ապատեղեկատվության տարածումը հարիր չէ քաղաքակիրթ իրավական պետությանը և կարող է վնասակար բնույթ կրել միջպետական հարաբերությունների համար: Հետևաբար, բոլոր լրատվական միջոցներին խնդրում ենք հնարավորինս զգոն վերաբերմունք ցուցաբերել երեխաների որդեգրման գործընթացը քննարկելիս կամ լուսաբանելիս:

Միաժամանակ, Արդարադատության նախարարությունը տեղեկացնում է, որ երեխայի որդեգրման գաղտնիքը որդեգրողի կամքին հակառակ հրապարակելու համար Հայաստանի Հանրապետության քրեական օրենսգրքով նախատեսում է քրեական պատասխանատվություն»:
