«Երեւանի մանկան տուն» ՊՈԱԿ-ի տնօրեն Լիանա Կարապետյանին կալանավորելու մասին ՀՀ Վերաքննիչ դատարանի որոշումը կբողոքարկվի Վճռաբեկ դատարանում: Այս մասին NEWS.am-ի հետ զրույցում ասաց Լիանա Կարապետյանի փաստաբան Ալեքսան Խաչատրյանը:

«Վերաքննիչը բավարարեց Դատախազության միջնորդությունը՝ խափանման միջոց կալանքը ընտրելու հետ կապված եւ մենք այդ որոշումը բողոքարկելու ենք Վճռաբեկ դաըարանում, իսկ ներպետական ատյանները սպառելուց հետո նաեւ Մարդու իրավունքների Եվրոպական դատարանում, քանի որ գտնում ենք, որ դա ապօրնի դատական ակտ է: Մենք հիմնավորել էինք, որ Լիանա Կարապետյանը որեւէ կերպ չի խոչընդոտել քննությանը մինչ այս պահը եւ այս պահից էլ որեւէ կերպ չի խոչընդոտելու, վարույթն իրականցնող մարմնից չի թաքնվելու, ընդ որում, դրա հետ կապված որեւէ ապացույց չկա, որ կարող է թաքնվել քննությունից կամ խոչընդոտել քննությանը: Ավելին ասեմ՝ նույնիսկ այս մտահոգությունները փարատելու համար Լիանա Կարապետյանը դիմում գրեց, ազատվեց աշխատանքից, որպեսզի նաեւ դրանով ցույց տա, որ որեւէ կերպ չի խոչընդոտի քննությանը»,-ասաց փաստաբանը: 

Նա նշեց, որ դեռ աշխատում են Վճռաբեկ բողոքի վրա եւ ուշադրություն հրավիրեց այն հանգամանքի վրա, որ նույն մեղադրանքով Ռազմիկ Աբրահամյանը չի կալանավորվում, իսկ Լիանա Կարապետյանը կալանավորվում է:

«Ամեն դեպքում ցանկալի չէ, որ գործը հասնի ՄԻԵԴ: Ես կցանկանայի նաեւ մեկ այլ աբսուրդ հանգամանքի վրա ուշադրություն դարձնել, որ Լիանա Կարապետյանը մեղադրվում է խմբի կազմում հանցանք կատարելու մեջ, դատական համակարգի խայտառակությունն է, որ մի մեղադրյալի՝ Ռազմիկ Աբրահամյանի դեպքում առաջին ատյանի դատարանը կալանավորման միջնորդությունը մերժեց հիմնավոր կասկածի բացակայության հիմքով, դատախազությունը բողոքարկեց, Վերաքննիչը մերժեց էլի հիմնավոր կասկածի հիմքով: Այսինքն՝ աբսուրդային իրավիճակ է, որ Լիանան Կարապետյանի դեպքում ասում է՝ հիմնավոր կասկած կա եւ կալանավորում է, իսկ Ռազմիկ Աբրահամյանի դեպքում՝ ոչ, երբ երկուսն էլ նույն մեղադրանքն ունեն: Սա մեր դատական համակարգի խայտառակությունն է»,- ասաց նա ՝ նշելով, որ նաեւ արգելանք է դրված Լիանա Կարապետյանի տեսակցությունների եւ մամուլի հետ շփումների վրա, որը նույնպես բողոքարկելու է:

Նշենք, որ Վերաքննիչ քրեական դատարանը հունվարի 29-ին բավարարել է դատախազության՝ «Երեւանի մանկան տուն» ՊՈԱԿ-ի տնօրեն Լիանա Կարապետյանին կալանավորելու միջնորդությունը։

Նշենք, որ նրան մեղադրանք է առաջադրվել օտարերկրացիներին երեխաների ապօրինի որդեգրման դեպքերի առթիվ հարուցված քրեական գործի շրջանակում։

Մեղադրանք է առաջադրվել նաեւ «Վերարտադրողական առողջության, պերինատոլոգիայի, մանկաբարձության եւ գինեկոլոգիայի հանրապետական ինստիտուտ» ՓԲ ընկերության (Հանրապետական ծննդատան) տնօրեն Ռազմիկ Աբրահամյանին, փոխտնօրեն Արշակ Ջերջերյանին։
