ՀՀ ԱԳՆ հայտարարությունը «Սարիբեկյանն ու Բալյանն ընդդեմ Ադրբեջանի» ՄԻԵԴ-ի վճռի առնչությամբ

ՀՀ արտաքին գործերի նախարարությունը հայտարարություն է տարածել «Սարիբեկյանն ու Բալյանն ընդդեմ Ադրբեջանի» ՄԻԵԴ-ի վճռի առնչությամբ։

«Հունվարի 30-ին ՄԻԵԴ-ը վճիռ է կայացրել Սարիբեկյանը և Բալյանն ընդդեմ Ադրբեջանի գործով: Այն վերաբերում է Ադրբեջանի վերահսկողության տակ հայտնված ՀՀ քաղաքացի  Մանվել Սարիբեկյանի՝ Ադրբեջանի ռազմական ոստիկանության բաժանմունքում մահվան հանգամանքներին: Մանվել Սարիբեկյանը 2010թ.-ի սեպտեմբերի 11-ին եղանակային վատ պայմանների պատճառով մոլորվել է Տավուշի մարզի սահմանամերձ հատվածում և հայտնվել ադրբեջանական կողմում, իսկ 1 ամիս անց՝ 2010թ.-ի նոյեմբերի 4-ին, Սարիբեկյանի դիակը հանձնվել է հայկական կողմին: Ըստ ադրբեջանական վարկածի՝ հայ հովիվն ինքնասպանություն էր գործել Ադրբեջանի ՊՆ ռազմական ոստիկանության ստորաբաժանումում:

Անհրաժեշտ է նշել, որ ադրբեջանական կողմն ակնհայտ սուտ մեղադրանքներով քրեական գործ էր հարուցել Մանվել Սարիբեկյանի հանդեպ և կտտանքների ներքո պարտադրել հանդես գալ ադրբեջանական հեռուստատեսությամբ:

Մարդու իրավունքների եվրոպական դատարանն արձանագրել է ՀՀ քաղաքացու` Մարդու իրավունքների եվրոպական կոնվենցիայով (այսուհետ՝ Կոնվենցիա) երաշխավորված հիմնարար իրավունքների խախտումներ, մասնավորապես՝  Կոնվենցիայի 2-րդ հոդվածի (կյանքի իրավունքի) և՛ նյութիրավական, և՛ դատաիրավական ասպեկտների, ինչպես նաև Կոնվենցիայի 3-րդ հոդվածի (խոշտանգումների արգելում) խախտում, քանի որ Մարդու իրավունքների եվրոպական դատարանի համար կասկածից վեր է, որ Սարիբեկյանը ենթարկվել է չափազանց լուրջ և դաժան տառապանքների, որոնք նրան հասցվել են միտումնավոր՝ ադրբեջանական իշխանությունների ուղղակի վերահսկողության ներքո գտնվող կալանավորված անձի նկատմամբ:

Վճիռն աննախադեպ է. Մարդու իրավունքների եվրոպական դատարանն առաջին անգամ ամրագրել է Ադրբեջանի պատասխանատվությունը ՀՀ քաղաքացուն կյանքի զրկելու գործում և արձանագրել, որ ՀՀ քաղաքացին տանջամահ է արվել մասնավորապես Ադրբեջանի ռազմական ոստիկանության ստորաբաժան անձնակազմի բռնի գործողությունների հետևանքով:

Այս վճիռն հերթական անգամ հաստատում է, որ Ադրբեջանը բացահայտորեն խախտում է մարդու իրավունքների պաշտպանության միջազգային պարտավորությունները: Այն նաև փաստում է, որ Ադրբեջանի իշխանությունների վերահսկողության ներքո հայտնված յուրաքանչյուր հայ, անկախ կարգավիճակից, ուղղակիորեն վտանգված է:

ՀՀ-ն շարունակական ջանքեր կգործադրի ՀՀ քաղաքացիների և հայ ժողովրդի անվտանգության ապահովման և արդարության վերականգնման ուղղությամբ»,-ասված է հայտարարությունում:
