ՀՀ վարչական դատարանում, դատավոր Արթուր Ծատուրյանի նախագահությամբ այսօր՝ փետրվարի 21-ին, սկսվեց ՀՀ երկրորդ նախագահ Ռոբեչտ Քոչարյանի «Կյանք եւ ազատություն» գրքի գովազդումը չթույլատրելու դեմ բողոքի վերաբերյալ դատական նիստը։

Հայցվորի ներկայացուցիչ Ալեքսանդր Կոչուբաեւը դատարանին հայտնեց, որ Երեւանի ավագանու որոշումը, որով կանոնակարգում է սույն գործով կողմերի համար բարենպաստ վարչական ակտի ընդունումը, պայմանավորում է երկու վարչական մարմնի առկայություն. «Այսինքն՝ փաստահավաք գործունեություն, որն իրականացնում է համապատասխան վարչական շրջանը եւ այդ փաստահավաք աշխատանքների հիման վրա վարչական ակտն ընդունվում է քաղաքապետարանի իրավասու ստորաբաժանումը, որը գործով երկրորդ պատասխանողն է՝ գովազդի վարչությունը։ Երկու վարչական մարմիններն էլ ոչ իրավաչափ գործողություններ են թույլ տվել, որը հանգեցրել է բարենպաստ վարչական ակտի ընդունման մերժմանը»։

Կենտրոն վարչական շրջանի ղեկավարի՝ պատասխանող կողմի ներկայացուցիչ Արամ Մարտիրոսյանն էլ ասաց, որ Երեւանի քաղաքապետարանի համապատասխան ստորաբաժանումը չի կարող առանձնացվել. «Կա վարչական շրջանի ղեկավար եւ մյուս աշխատակիցները իրականացնում են գործունությունը Երեւան համայնքի անունից, հետեւաբար առանձնացումը եւ որպես դատավարության առանձին մասնակից ներգրավվելը գտնում ենք, որ ոչ իրավաչափ է։ Այս պարագայում Երեւանի քաղաքապետարանը կարող է պատշաճ պատասխանող հանդես գալ»։
