Ինչպես արդեն տեղեկացրել էինք, ՔԿՀ-ներում պահվող նախնական կալանքի տակ գտնվող անձանց կորոնավիրուսային վարակումից եւ հիվանդությունից պաշտպանելու միջոցառումների շրջանակներում ՀՀ դատախազությունն սկսել է առաջնային ռիսկի գոտում գտնվող կալանավորված անձանց նկատմամբ խափանման միջոցի փոփոխման նախաձեռնություն: Այս մասին Facebook-ի իր էջում գրել է Գլխավոր դատախազի խորհրդական Գոռ Աբրահամյանը:

Նա, մասնավորապես, նշել է. «Այդ նպատակով իրականցվել էր ազատությունից զրկելու հետ չկապված խափանման միջոցներ կիրառելու հիմքերի, իրավական մեխանիզմների նախնական ուսումնասիրություն՝ հաշվի առնելով նաեւ ազատության մեջ հայտնվելու պարագայում նրանց կողմից ոչ պատշաճ վարքագծի դրսեւորման, ազատության մեջ գտնվելու պայմանները չխախտելու հնարավոր ռիսկերը:

Առանձնացվել էին նախաքննության եւ դատական քննության փուլում գտնվող քրեական գործերով խոցելի տարիքային խմբում գտնվող, ծանր եւ/կամ խրոնիկական, մի քանի համակցված հիվանդություններ ունեցող, ներկայումս բժշկական հաստատություններում, հիմնականում «Դատապարտյալների հիվանդանոց» ՔԿՀ-ում բժշկական օգնություն ստացող 11, ինչպես նաեւ այլ քրեակատարողական հիմնարկներում գտնվող 9 կալանավորված անձինք:

Մինչեւ ապրիլի 6-ը ներառյալ անմիջականորեն դատախազների որոշումներով արդեն իսկ փոփոխվել են նախաքննության փուլում գտվող գործերով անցնող 3 մեղադրյալների նկատմամբ խափանման միջոցները՝ ընտրելով ստորագրություն չհեռանալու մասին: Բացի այդ, դատական քննության փուլում գտնվող գործերով դատախազների կողմից հրատապության կարգով դատարաններ ներկայացված՝ 6 անձի նկատմամբ նախնական կալանքը փոփոխելու միջնորդություններ բավարարվել են: Որպես կանոն՝ դատարանների կողմից եւս ընտրվել է ստորագրություն չհեռանալու մասին խափանման միջոցը: Վերոնշյալ 9 անձանցից 4-ը «Դատապարտյալների հիվանդանոց» ՔԿՀ-ում գտնվող անձինք են, 5-ը՝ այլ ՔԿՀ-ներում:

Գործընթացը շարունակվում է, առկա են արդեն իսկ դատարաններ ներկայացված այլ միջնորդություններ, որոնցով նախատեսված են դատական նիստեր, ինչպես նաեւ մշակման փուլում գտնվող միջնորդություններ, քննարկվող գործեր:

Այն անձանց տվյալները, ովքեր նշված գործընթացի արդյունքում հայտնվում են ազատության մեջ, փոխանցվում են նրանց հետագա գտնվելու, փաստացի բնակության վայրերի տարածքների ոստիկանական բաժանմունքներին՝ արտակարգ դրությամբ պայմանավորված սահմանափակումների, ինքնամեկուսանալու պարտադիր պայմանների ու պահանջների կատարման, ինչպես նաեւ նրանց պատշաճ վարքագծի նկատմամբ խիստ հսկողություն իրականացնելու նպատակով՝ հաշվի առնելով առաջին հերթին ազատության մեջ գտնվելու պայմանների հնարավոր խախտումները, հատկապես պատասխանատվությունից խուսափելու, նոր հանցանք կատարելու դեպքերը բացառելու խիստ անհրաժեշտությունը:
