«Քաղաքական ազդեցությունը իրավապահ մարմինների նկատմամբ ոչնչացնում է քրեական հետապնդման իրավաչափությունը»,- նշված է «Լուսավոր Հայաստան» կուսակցության երեկ տարածած հայտարարության մեջ։ Ի՞նչ հետևանքներ կարող է ունենալ երեկվա իրադարձությունը, ի՞նչ հետևություն կանեն իշխանությունները և արդյո՞ք կկարողանան շեշտը պահել իրավական գործընթացի վրա։ ։
Եթե նույնիսկ դատաիրավական կառույցների կողմից օրենքով պատշաճ կատարվեն բոլոր միջոցառումները, միևնույն է՝ թեման շարունակաբար քաղաքականցվելու է, քանի որ երեկվա զանգվածային ընդվզումն արդեն խնդրին հաղորդել է քաղաքական աստառ։ Այսինքն՝ արդեն իսկ կատարվել են քայլեր, որոնց արդյունքում խնդիրը քաղաքական ենթատեքստ է ստացել։ Ուստի՝ պատկերը դատաիրավական տրամաբանության մեջ դժվար թե կտեղավորվի։ Իսկ եթե հաշվի առնենք, որ իշխանությունը տիրապետում է օբյեկտիվ և լիարժեք տեղեկատվությանը, և ինքն է սահմանում քաղաքական առաջնահերթությունները, ապա կարելի է ենթադրել, որ իշխանությունը միտումնավոր է կազմակերպել այնպես, որ քաղաքականացվի թեման և ստվերվի խնդրի իրավական կողմը։ Այստեղից՝ հավելյալ պարզ է, թե ինչու է խորհրդարանական կուսակցությունն արձանագրում, որ «իրավապահ մարմինների նկատմամբ քաղաքական ազդեցությունը ոչնչացնում է քրեական հետապնդման իրավաչափությունը»։
Մեծամասնությունը և նրան սատարողը որոշ ժամանակ դեռ կպնդեն, որ սա բացառապես իրավական գործընթաց է։ Ենթադրենք, թե իշխանությունն, իրոք, շահագրգռված չի խնդիրը քաղաքական տրամաբանությամբ մատուցելու մեջ։ Եթե այդպես լիներ, ապա այս գործընթացը կարող էին կազմակերպել քրեաիրավական պարզ ընթացակարգով՝ ծանուցագիր կուղարկեին, կնշեին քրեական գործերի հարուցման ու հարցաքննության անհրաժեշտության հիմքերը, դրանց վերաբերյալ պատշաճ հրապարակումներ կանեին մամուլում, պահպանելով անմեղության կանխավարկածը, քննությունը կվարեին բացառապես իրավական գործիքակազմով, կփակեին Նալբանդյան փողոցը նախքան ցուցարարների հոսքը և այլն։ Այնինչ՝ իշխանություններն արեցին հնարավոր ամեն ինչ, ներառյալ՝ պատգամավորների նկատմամբ բռնության գործադրումները, որպեսզի խնդիրը քաղաքականցվի և միջազգային արձագանք ստանա։
Այսպիսով՝ եթե իշխանությունների երեկվա նախաձեռնությունը քաղաքական անթաքույց ենթատեքստ ունի, ապա ի՞նչ խնդիր է հետապնդում։ Արդյո՞ք տեղավորվում է համավարակի դեմ պայքարի համատեքստում, թե՞ այլ քաղաքական նպատակ է հետապնդում. Պարզ չի ասվում։ Բայց պարզ է այն, որ համավարակի դեմ պայքարի թեժ շրջանում հասարակական համերաշխությունը հարվածի տակ դրվեց։ Այնինչ՝ օրակարգը պարտավորեցնում է հաշտեցնել և մոբիլիզացնել բոլոր ուժերն ու միջոցները ներկա ճգնաժամից միասնաբար դուրս գալու, անկախության և ժողովրդավարության 2-րդ փուլի բերափոխումներ իրականացնելու և ազգային առաջընթաց ապահովելու համար։
