Հայաստանի Հանրապետության ազգային անվտանգության ծառայությունը շարունակելով իր գործառույթների շրջանակներում գործուն պայքար մղել Արցախի Հանրապետությունից Հայաստանի Հանրապետության տարածք ապօրինի կերպով հրազեն, փամփուշտներ, ռազմամթերք,  պայթուցիկ նյութեր կամ պայթուցիկ սարքեր ձեռք բերելու, իրացնելու, պահելու, փոխադրելու կամ կրելու դեպքերը բացահայտելու և շրջանառությունն արգելված նշված առարկաները որպես գործիք օգտագործելով հնարավոր հանցագործությունները նախականխելու և կանխելու ուղղությամբ, բացահայտել է իրացնելու նպատակով մարտի դաշտից ապօրինի կերպով զենք ձեռք բերելու և պահելու  հանցավոր խումբ:

Մասնավորապես.

Երևան քաղաքի բնակիչ Ս.Բ.-ն 2020 թվականի սեպտեմբերի 27-ից որպես կամավոր մասնակցելով Արցախի Հանրապետության դեմ սկսված պատերազմական գործողություններին, մի շարք անձանց հետ ձեռք բերված նախնական համաձայնությամբ, իրացման նպատակով, ապօրինի ձեռք է բերել հրազեն հանդիսացող ինքնաձիգներ, որոնք Արցախի Հանրապետությունից փոխադրել և պահել է Երևան քաղաքում գտնվող իր բնակարանում, որից հետո՝ 2020 թվականի նոյեմբերի 3-ին, յուրաքանչյուր ինքնաձիգը 500-600 ԱՄՆ դոլար գումարով վաճառելու վերաբերյալ պայմանավորվածություններ է ձեռք բերել տարբեր անձանց հետ:

Դեպքի առթիվ ՀՀ ԱԱԾ քննչական դեպարտամենտում ՀՀ քրեական օրենսգրքի 235-րդ հոդվածի հատկանիշներով հարուցված քրեական գործի նախաքննությամբ կատարված բազմածավալ քննչական և այլ դատավարական գործողությունների արդյունքում, մասնավորապես՝ Ս.Բ-ի բնակարանում կատարված խուզարկությամբ հայտնաբերվել և առգրավվել են «Կալաշնիկով» տեսակի ինքնաձիգներ, ռազմամթերք հանդիսացող փամփուշտներ և շրջանառությունն արգելված այլ իրեր:

Քրեական գործով որպես մեղադրյալ ներգրավված Ս.Բ.-ին հրազեններ իրացրած անձի ինքնությունը պարզելու ուղղությամբ ձեռնարկված բազմատեսակ քննչական և դատավարական այլ գործողությունների արդյունքում՝ Սյունիքի մարզի Տեղ գյուղում գտնվող թաքստոցներից հայտնաբերվել է մարտի դաշտից իրացման նպատակով ապօրինի ձեռք բերված և պահված   ռազմամթերք հանդիսացող մեծաքանակ փամփուշտներ, հրազեն հանդիսացող ինքնաձիգներ և շրջանառությունն արգելված բազմաթիվ այլ իրեր ու առարկաներ:

Մասնավորապես.

Կատարված խուզարկություններով հայտնաբերվել են մարտի դաշտից ապօրինի ձեռք բերած և Հայաստանի Հանրապետություն ապօրինի տեղափոխած ընդհանուր թվով 43 հատ «Կալաշնիկով» տեսակի ինքնաձիգներ,  279 հատ 7.62մմ տրամաչափի փամփուշտներ, 7 հատ փամփշտատուփ` լիցքավորված 7.62մմ տրամաչափի փամփուշտներով, 23 հատ փամփշտատուփ` լիցքավորված 5.45մմ տրամաչափի փամուշտներով, սվին դանակներ, զինվորական կողապայուսակներ, ատրճանակի պատյաններ, 1 հատ փամփշտատուփ՝ թվով 8 հատ 9մմ տրամաչափի փամփուշտներով, թվով 32 հատ փակ տուփերով փոքր չափերի փամփուշտներ, ինքնաձիգների նշանառության համար նախատեսված օպտիկական սարքեր, որսորդական հրացաններ, 227 հատ 7.62մմ տրամաչափի փամփուշտներ, 1033 հատ 5.45մմ տրամաչափի փամփուշտներ, 1 հատ նռնակ, որսորդական հրացանի փողեր և այլն:

ՀՀ ազգային անվտանգության ծառայությունը շարունակում է ձեռնարկել ակտիվ օպերատիվ-հետախուզական միջոցառումներ մարտի դաշտից ապօրինի կերպով Հայաստանի Հանրապետության տարածք տեղափոխած հնարավոր այլ զենքերն ու զինամթերքները  հայտնաբերելու և դրանում ներգրավված բոլոր անձանց նկատմամբ քրեական հետապնդումներ հարուցելու համար:

Միաժամանակ, Հայաստանի Հանրապետության ազգային անվտանգության ծառայությունը հորդորում է մարտերին մասնակցած և ռազմական գործողությունների ժամանակահատվածում կամ հրադադարի հաստատումից հետո իրենց հետ Հայաստանի Հանրապետության տարածք ապօրինի փոխադրած և պահած զենք-զինամթերքը, պայթուցիկ նյութերը կամ սարքերը ինքնակամ հանձնել  իրավապահ մարմիններին, որպիսի գործողությունները օրենքով սահմանված կարգով հիմք կհանդիսանան անձին քրեական պատասխանատվությունից ազատելու համար:

Ծանուցում. Ենթադրյալ հանցանքի մեջ կասկածվողը կամ մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով։
