«Ինձ համար սա բարոյական հարց էր»․ դատարանն անվավեր է ճանաչել Ամատունի Վիրաբյանի վերաբերյալ նախարարի որոշումը

Երևանի ընդհանուր իրավասության դատարանը որոշել է բավարարել Ազգային արխիվի նախկին տնօրեն Ամատունի Վիրաբյանի հայցը, անվավեր ճանաչել նրան պաշտոնից ազատելու՝ ՀՀ արդարադատության նախարար Ռուստամ Բադասյանի հրամանը և նրան վերականգնել նախկին աշխատանքում։

ԼՈՒՐԵՐ․com-ի հետ զրույցում Ամատունի Վիրաբյանն ասաց իր համար ի սկզբանե պարզ էր, որ այսպես էր լինելու․ «Ես ի սկզբանե գիտեի, որ այդպես է լինելու, որովհետև ինձ ազատել էին մի պատճառաբանությամբ, որը որևիցե հիմք չուներ, այն է՝ հարկեր չվճարելը։ Հարկերը չէին վճարվել, մենք դիմել էինք կառավարություն, վերջինս էլ պահուստային ֆոնդից գումար հատկացրեց՝ վճարեցինք։ Եթե ես ինչ-որ հարցում մեղավոր էի, ինչո՞ւ էին գումարը տալիս։ Այդ գումարը չէին վճարել բոլոր ՊՈԱԿ-ները, այդ թվում Ազգային արխիվը և բոլոր ՊՈԱԿ-ներին այդ գումարները տվել են։ Նախարարը հրաման էր տվել հարկեր չվճարելու համար ազատել աշխատանքից։ Բան էին ուզում գտնել, տեսան չկա՝ հարկերը պատճառ բռնեցին»,- ասաց նա։

Արդյոք շարունակելո՞ւ է աշխատել որպես Ազգային արխիվի տնօրեն՝ հարցին ի պատասխան Վիրաբյանն ասաց, որ դեռ չի կողմնորոշվել․ «Հնարավոր է, կտեսնենք, կյանքը ցույց կտա։ Հիմա չեմ կարող ասել, քանի որ մեկ ամիս հետո նոր ուժի մեջ է մտնելու։ Ինձ համար սա ավելի շատ բարոյական խնդիր էր, որ նախարարն ինձ անհիմն ձևով ազատել է աշխատանքից»,- նշեց Ամատունի Վիրաբյանը։ 

Նշենք, որ դատարանը որոշել է անվավեր ճանաչել նախարարի հրամանը, բավարարել հարկադիր պարապուրդի գումարը բռնագանձելու՝ Ամատունի Վիրաբյանի պահանջը, Վիրաբյանին վերականգնել «Հայաստանի ազգային արխիվ» ՊՈԱԿ-ի տնօրենի պաշտոնում: Բացի այդ՝ դատարանը որոշել է նաև Արդարադատության նախարարությունից հօգուտ ՀՀ պետական բյուջեի բռնագանձել 4.000 ՀՀ դրամ գումար որպես պետական տուրք, հօգուտ  Ամատունի Վիրաբյանի՝ 50.000 ՀՀ դրամ՝ որպես փաստաբանի խելամիտ վարձատրության գումար: Վճիռն օրինական ուժի մեջ է մտնում հրապարակման պահից մեկ ամիս հետո:
