ՀՀ ԶՈՒ ԳՇ նախկին պետ Օնիկ Գասպարյանի փաստաբանական խմբի անդամ Մարտիկ Մարտիրոսյանը ֆեյսբուքյան իր էջում գրել է․

«ՍԴ երկար սպասված որոշումը վերջապես հրապարակվեց և, իմ առաջին տպավորությամբ, էլ ավելի վատացավ բարձրագույն հրամանատարական կազմի զինծառայողների իրավական դրությունը։ Բարձրագույն հրամանատարական կազմի զինծառայողների պաշտոնավարումն այլևս ամբողջությամբ կախված է քաղաքական ղեկավարության կամքից և ցանկությունից։ Այն չի կարող դրական ազդեցություն ունենալ զինծառայողների կարգավիճակի վրա, քանի որ բարձրագույն հրամանատարական կազմի մասնագիտական ունակությունները երկրորդվում են քաղաքական ղեկավարության ցանկություններին։

Երկար-բարակ գրելուց հետո ասվում է, որ Սահմանադրության 155-րդ հոդվածի 3-րդ մասով սահմանվում է ԶՈՒ շտաբի պետի պաշտոնավարման առավելագույն ժամկետ։ Այդ եզրակացության հետ կարելի էր համաձայնվել, եթե Սահմանադրությամբ նշվեր, որ օրենքով սահմանվում է շտաբի պետի պաշտոնավարման առավելագույն ժամկետ, մինչդեռ սահմանադրության մեջ հստակ գրված է, որ ՀՀ ԶՈՒ շտաբի պետը նշանակվում է օրենքով սահմանված ժամկետով։

Բացի այդ, նշվում է՝ եթե օրենքով սահմանված է, որ զինծառայողը կարող է ազատվել հայեցողությամբ, ապա դա որոշակի է և իրավաչափ։ Նույն տրամաբանությամբ կարող է օրենքով նշվել, որ բարձրագույն հրամանատարական կազմի զինծառայողները կարող են ազատվել օրենքով չնախատեսված հիմքով։ Եվ երբ զինծառայողը բողոքի, որ իրեն ազատել են օրենքով չնախատեսված հիմքով, ապա որպես հակափաստարկ կարող է բերվել, որ դա նախատեսված է օրենքով։

Որոշմամբ նաև նշվում է, որ  բարձրագույն հրամանատարական կազմի ներկայացուցչին ազատելու հիմքում կարող են ընկած լինել բազմաթիվ գործոններ, այդ թվում՝ քաղաքական չեզոքության խախտումը, կադրային-որակական գործոնը։ Թվարկված հիմքերի հետ կապված հարկ է նշել, որ առանց վիճարկվող հոդվածի կիրառման էլ կարող է անցկացվել ծառայողական քննություն (օրինակ՝ ՆԾԿ կանոնների խախտման մասով, եթե առկա է քաղաքական չեզոքության խախտման մասին տվյալ) կամ ատեստավորում։ Ինչ վերաբերում է ԳՇ պետի պաշտոնին, ապա նշված գործընթացներն իրականացնելու հնարավորություն առկա չէ, և ՍԴ չի էլ անդրադարձել այդ կառուցակարգի բացակայությանը և չի ասել, թե ով է գնահատելու որակական գործոնը կամ քաղաքական չեզոքության խախտումը», - գրել է Մարտիրոսյանը։
