Այսքան ապացույցներ ունենալով՝ պարտվեցինք. ո՞վ է իրավիճակի պատասխանատուն. «Ժողովուրդ»

«Ժողովուրդ» օրաթերթը գրում է․ Մոտ մեկ ամիս առաջ համացանցում մերձիշխանական գործիչները տարածում էին տեղեկություն, թե ՄԱԿ-ի միջազգային արդարադատության դատարանում Հայատանը ջախջախիչ հայց է ներկայացրել Ադրբեջանի դեմ: Բոլորս շնչակտուր սպասում էինք վերջնարդյունքին, որն, անշուշտ, պիտի ազդարարեր Ադրբեջանի վայրագությունների համար պատժիչ գործողությունների սկիզբը, բայց, ոչ, հերթական հիասթափությունն ապրեցինք. Հաագայում ՄԱԿ-ի արդարադատության միջազգային դատարանը անհրաժեշտ համարեց երկու կողմերին՝Հայաստանին եւ Ադրբեջանին ուղղված լրացուցիչ միջոց ձեռնարկել:

Ըստ այդմ, պետք է Ադրբեջանն անհրաժեշտ միջոցներ ձեռնարկի հայերի դեմ ռասայական ատելության հրահրումը կանխելու համար: «Ադրբեջանը, ռասայական խտրականության բոլոր ձեւերի վերացման մասին միջազգային կոնվենցիայով ստանձնած պարտավորություններին համապատասխան, պետք է բանտարկյալներին պաշտպանի բռնությունից եւ վնասից… եւ պետք է ձեռնարկի բոլոր անհրաժեշտ միջոցները՝ կանխելու էթնիկ հայերի նկատմամբ ռասայական ատելության եւ խտրականության հրահրումը, այդ թվում՝ պաշտոնյաների կողմից»,- ասել է դատարանի նախագահ Ջոան Դոնոհյուն: Նույն դատավորը նաեւ Հայաստանին է կոչ արել քայլեր ձեռնարկել ադրբեջանցիների հանդեպ ռասայական ատելության հրահրումը կանխելու համար՝ հավելելով. «Հայաստանը, համապատասխան իր ստանձնած պարտավորությունների՝ կապված ռասայական խտրականության ցանկացած ձեւերի վերացման մասին միջազգային կոնվենցիայի հետ, պետք է անհրաժեշտ քայլեր ձեռնարկի, որպեսզի կանխի ռասայական ատելության հրահրումն ու սանձազերծումը ադրբեջանցիների հանդեպ, այդ թվում՝ իր տարածքում գտնվող կազմակերպությունների եւ անձանց կողմից»,- ասել է դատավորը՝ հրապարակելով Բաքվի հայցն՝ ընդդեմ Երեւանի՝ Հայաստանի կողմից ռասայական խտրականության բոլոր ձեւերի վերացման մասին կոնվենցիայի խախտման մեղադրանքով։

Այսպիսով, ինչ է ստացվում. նոյեմբերի 9-ից հետո ՀՀ-ն բոլոր գերիներին վերադարձրել է, իսկ Ադրբեջանը ոչ միայն պահում, այլեւ խոշտանգում ու դատում է մեր գերիներին, մաս-մաս իր նպատակահարմարությամբ վերադարձնում է, սակայն ՀԱԱԳԱ-ի դատարանը հավասարության նշան է դնում մեր ու Ադրբեջանի միջեւ եւ հայցի ապահովման միջոց կիրառում նաեւ ՀՀ-ի նկատմամբ:

Իսկ ո՞վ է այս իրավիճակի պատասխանատուն մեր երկրի ներսում. ՄԻԵԴ-ում ՀՀ կառավարության մշտական ներկայացուցիչ Եղիշե Կիրակոսյանի գլխավորած խումբը պետք է ոչ միայն հայց ներկայացներ Բաքվի դեմ, այլեւ հիմնավորեր ու պաշտպաներ հայցը: Իսկ ՀՀ գլխավոր դառախազ Արթուր Դավթյանը, որ պարբերաբար հայտարարում է, թե քրգործ է հարուցվել ադրբեջանական այս կամ այն վայրագության առիթով, եւ դրանք օգտագործվելու են միջազգային ատյաններում քաղաքացիների իրավունքների պաշտպանության համար, պետք է կարողանար քրգործերի շրջանակներում այնպիսի ապացույցներ հավաքել Ադրբջանի դեմ, որ անհերքելի լինեին: Բայց ստացվում է՝ այսքան ապացույցների պայմաններում Հայաստանը փաստացի խոցելի վիճակում է հայտնվում: Կա՛մ Եղիշե Կիրակոսյանի խումբը չի կարողացել իբրեւ անհերքելի ապացույց պատշաճ ներկայացնել մեր փաստարկները, կա՛մ դատախազության հավաքած ապացույցները բավարար չեն եղել (ինչպես շատ աղմկահարույց քրգործերի դեպքում, դրանք էլ են փուչիկ), կա՛մ էլ Ալեն Սիմոնյանի տրամաբանությամբ են առաջնորդվել ՀՀ կառավարության ներկայացուցիչները, որ գերիներ չկան….

Մի խոսքով, բյուրավոր ապացույցներ ունենալով՝ էլի դատարանում (այս փուլում փաստացի) պարտվեցինք: Մնում է սպասել քննության ավարտին:
