Նախօրեին բոլորս ականատես դարձանք, թե ինչպես ՍԴ-ն հրապարակեց ՀՀ առողջապահության նախարարի՝ աշխատողների հաշվին COVID-19 ախտորոշման՝ ՊՇՌ հետազոտություններ կատարելու և պատվաստվելու պարտականություններ սահմանող հրամանի վերաբերյալ որոշման եզրափակիչ մասը։  Նշենք, որ ՍԴ որոշման հետ կապված ընկալումներն ու մեկնաբանությունները բավականին հակասական են, և պատճառը եզրափակիչ մասի տեքստի բովանդակությունն է։

Բանն այն է, որ հանրային մի հատված մեծապես ոգևորված է ՍԴ որոշման այն ձևակեպումից, որ՝ «իր հաշվին» բառակապակցությունը ճանաչվել է հակասահմանադրական՝ ենթադրելով, որ առողջապահության նախարարի հրամանի՝ ՊՇՌ թեստերն աշխատողների միջոցների հաշվին կատարելու դրույթն այլևս գոյություն չունի, դեռ ավելին՝ ակնկալվում է, որ պետք է ստանալ արդեն իսկ կատարված անօրինական ծախսերի փոխհատուցումը։ Մյուս կողմից՝ ՍԴ այս որոշումից հետո առողջապահության նախարարությունը հայտարարություն է տարածել, ըստ որի՝ քանի որ հակասահմանադրական է ճանաչվել միայն «իր հաշվին» բառակապակցությունը, հետևաբար՝ առողջապահության նախարարի հրամանը ճանաչվել է սահմանադրական, բոլոր պահանջները մնում են ուժի մեջ և հաշվի առնելով, որ պետությունը արտոնյալ ու անվճար պայմաններով չի երաշխավորում ՊՇՌ թեստավորումը, աշխատողներն ամեն դեպքում պետք է իրականացնեն թեստավորում:

Նկատենք մի կարևոր դրվագ. մի շարք իրավաբաններ մասնագիտական կարծիք են հայտնում, որ «իր հաշվին» բառակապակցությունը հակասահմանադրական ճանաչելն ամենևին էլ չի նշանակում, թե աշխատողի փոխարեն մեկ ուրիշը պետք է վճարի նրա ՊՇՌ հետազոտության համար, այն պետք է շարունակի վճարել աշխատողը, քանի որ ՊՇՌ հետազոտությունն իրականացնելու պարտականությունը մնացել է սահմանադրական և որևէ միանշանակ պարտավորություն պետության վրա դրված չէ, այդ թվում՝ ծախսերը հոգալու մասով։ Իրավաբանները նաև հեգնում են, որ առողջապահության նախարարի հրամանի հակասահմանադրական և պրիմիտիվ ձևակերպումները ՍԴ-ն «հակասահմանադրական» ճանաչեց նույն պրիմիտիվությամբ, աբսուրդի հասնող ձևակերպումներով, որը կարող է հանգեցնել քաոտիկ վիճակի։

Ի դեպ՝ կան տեղեկություններ, որ ՍԴ-ի այս որոշումը չի ընդունվել միաձայն։ ՍԴ-ի նախկին, հին գվարդիայի երեք դատավորներ դեմ են եղել խնդիրը չլուծող, խնդիրը խորացնող, հակասական դիրքորոշումներով «որոշում» ընդունելուն։ Հավելենք նաև, որ քննարկվում է նաև տարբերակ, ըստ որի՝ ՊՇՌ թեստերի հանձնման գործընթացի սակագինը հնարավոր է իջեցնել մինչև 3000-4000 դրամ ( նշենք, որ թեստերը ՀՀ են ներմուծվում 2000 դրամով)։
