ՄԻՊ-ն արձագանքել է դատավոր Բախշիյանի նկատմամբ իրականացվող հետապնդմանը

ՀՀ մարդու իրավունքների պաշտպանին են դիմել Սյունիքի մարզի ընդհանուր իրավասության դատարանի դատավոր Բորիս Բախշիյանի փաստաբանները՝ նշելով, որ իրենց վստահորդի նկատմամբ իրականացվում է անօրինական քրեական հետապնդում, ինչպես նաև որ վտանգված է նրա անձնական ազատության իրավունքը: Այս մասին ֆեյսբուքյան իր էջում գրել է ՄԻՊ Արման Թաթոյանը։ 

«Ըստ փաստաբանների՝ հարցը վերաբերում է իրենց վստահորդը հանդիսացող դատավորի վարույթում գտնվող ու դեռ նրա վարույթում շարունակվող գործով դատավորի կողմից՝ որպես քրեական վարույթն իրականացնող մարմին, իր իրավասության սահմաններում որոշում կայացնելուն: Փաստաբանները նշել են նաև, որ քրեական հետապնդման մարմնի արարքները ոտնձգություն են դատավորի անկախության նկատմամբ:

Մարդու իրավունքների պաշտպանի աշխատակազմում ուսումնասիրվել է նաև ՀՀ դատավորների միության հայտարարությունը, որով մտահոգություն է հայտնվել նշված՝ Բորիս Բախշիյանի գործի հետ կապված:

ՀՀ մարդու իրավունքների պաշտպանի աշխատակազմն արձանագրել է նաև, որ ՀՀ բարձրագույն դատական խորհուրդը բավարարել է դատավորի նկատմամբ քրեական հետապնդում հարուցելու և նրան ազատությունից զրկելու համաձայնություն տալու մասին քրեական հետապնդման մարմնի միջնորդությունները:

Ուսումնասիրելով ՀՀ մարդու իրավունքների պաշտպանին հասցեագրած Բորիս Բախշիյանի փաստաբանների բողոքի հանգամանքները, ՀՀ դատավորների միության, ՀՀ գլխավոր դատախազության հայտարարությունները՝ Մարդու իրավունքների պաշտպանը հարկ է համարում արձանագրել, որ դատավորի նկատմամբ քրեական հետապնդում հարուցելու ու հատկապես նրան անձնական ազատությունից զրկելու հարցը քննարկելիս քրեական վարույթի այս փուլում առանձնապես կարևոր է պարզել, թե դատավորը կոնկրետ իրավիճակում կարող էր արդյոք սեփական հայեցողությամբ գնահատել գործի հանգամանքները և կայացնել անձին կալանավորելու որոշում այնպիսի գործով, որում հանդես է գալիս՝ որպես վարույթն իրականացնող մարմին:

Այս պայմաններում կարևոր հանգամանք է նաև այն, որ, ինչպես Պաշտպանին տեղեկացրել են փաստաբանները, դատախազը չի բողոքարկել կալանք կիրառելու մասին դատարանի այն որոշումը, որի համար նա հետապնդվում է:

Մարդու իրավունքների պաշտպանը մշտապես է քննադատության ենթարկել խափանման միջոց կալանքների չարաշահման պրակտիկան դատարանների կողմից, բայց այս հայտարարությունը վերաբերում է կոնկրետ իրավիճակի և այդ կոնկրետ իրավիճակում որոշում կայացնելու դատավորի իրավասությանն ու միևնույն ժամանակ` այդ որոշման համար իրավապահ մարմնի կողմից դատավորին քրեական հետապնդման ենթարկելու իրավաչափությանը: Այս հարցը համակարգային կարևորություն ունի նաև դատական իշխանության անկախության տեսանկյունից:

Մարդու իրավունքների պաշտպանի համար սույն գործով պարզելու ենթակա կարևոր հանգամանք է նաև փաստաբանների պնդումն առ այն, որ դատավոր Բորիս Բախշիյանի նկատմամբ քրեական հետապնդումը կապված է մեկ այլ գործով անձին կալանքից ազատելու նրա որոշման հետ: Այս մասին ակնարկ կա նաև ՀՀ դատավորների միության հայտարարությունում:

Փաստաբանների բողոքի հիման վրա գրություն կհասցեագրվի համապատասխան քրեական հետապնդման մարմնին»,- գրել է Արման Թաթոյանը։
