«Փաստ» օրաթերթը գրում է

Տոնական օրերին կամ էլ այլ առիթներով սպառողները որոշում են օգտվել խանութների կամ էլ այլ ծառայությունների զեղչերից: Տարաբնույթ գայթակղիչ ակցիաներ, «մինչև 70 տոկոս զեղչ, կես գին, երկու կոշիկը` մեկի գնով» և այլն: Համաձայնեք՝ գրավիչ առաջարկ է, բայց հաճախ նաև մտածում ենք` իսկ ո՞րն է վաճառողի օգուտն, ասենք, 70 հազար դրամանոց վերարկուն մեզ 35 հազար դրամով վաճառելու մեջ: Ես էլ մեկ անգամ գայթակղվեցի զեղչով կոշիկ գնելու մտքով: 40 հազար դրամ չէի վճարի կոշիկի համար, բայց երբ իմացա, որ խանութը որոշել է կես գնով վաճառել իր տեսականին, շտապեցի այնտեղ: Եվ ինչպիսին էր իմ զարմանքը, երբ տեսա, որ պիտակի վրա որպես կոշիկի հին գին նշված է 80 հազարը, և այն զեղչվել ու այժմ վաճառվում է 40 հազար դրամով: Իհարկե, այդ կոշիկն այդպես էլ չգնեցի, խաբված ու հիասթափված հեռացա: Հիմա ակցիաների ու զեղչերի պարագայում գրեթե անտարբեր եմ:

Շատերը կհամաձայնեն, որ նման դեպքեր նաև իրենց հետ են եղել: Գուցե այս և մի շարք այլ մտահոգություններ հաշվի առնելով էլ Մրցակցության պաշտպանության հանձնաժողովն առաջարկում է լրացումներ կատարել «Առևտրի և ծառայությունների մասին» և «Տնտեսական մրցակցության պաշտպանության մասին» օրենքներում: Նախագծում նշվում է, որ ժամանակակից առևտրի և ծառայությունների իրականացման գործընթացում նշանակալից դեր ունեն ակցիաները, զեղչերը և այլ մարկետինգային գործունեության միջոցառումները, որոնք սպառողներին (գնորդներին) հնարավորություն են ընձեռում ապրանքները ձեռք բերել կամ ծառայությունները ստանալ առավել գրավիչ և շահեկան պայմաններով։

Միևնույն ժամանակ ակցիա իրականացնողների գործողություններում նկատվում են խնդիրներ՝ պայմանավորված ակցիայի վերաբերյալ օրենսդրական կարգավորումների բացակայությամբ, այդ պայմաններում վաճառողների և ծառայություններ մատուցողների կողմից իրականացվող մարկետինգային միջոցառումների ընթացքում հանդիպում են հասարակությանը մոլորեցնելու դրսևորումներ: Հանձնաժողովը առանձնացրել է գործնականում հանդիպող մի շարք խնդիրներ: Օրինակ` ակցիայի իրականացմանը նախորդող ժամանակահատվածում ապրանքի իրացման գնի կամ ծառայության մատուցման գնի կտրուկ բարձրացումը, որին հաջորդում է ակցիայի կիրառումն արդեն իսկ բարձրացված գնից, ակցիայի պայմանների վերաբերյալ թերի, ոչ հավաստի տեղեկատվության հրապարակումը, ակցիայի վերաբերյալ տեղեկատվության հրապարակումը փաստացի ակցիայի բացակայության պայմաններում, դրա իրականացման ժամանակային սահմանափակում չունենալը, այդ պայմաններում ակցիայի արդյունքում սահմանվող գինը դառնում է ապրանքի իրացման կամ ծառայության մատուցման փաստացի գին:

Մրցակցության պաշտպանության հանձնաժողովն ընդգծում է, որ նշված խնդիրների լուծման նպատակով անհրաժեշտություն է առաջացել նախաձեռնելու օրենսդրական բարեփոխումների աշխատանքներ, այդ ընթացքում ուսումնասիրվել է նաև միջազգային փորձը: Սա անելու համար երկու օրենքներում առաջարկվում է կատարել լրացումներ, որոնք կկարգավորեն մի շարք հարցեր, այդ թվում` ակցիայի հասկացությունը և տեսակները, զեղչի հասկացությունը և կիրառման պայմանները, այդ թվում՝ ժամկետային սահմանափակումը և այլն, ապրանքի իրացման կամ ծառայության մատուցման գնի փոփոխման հետ չկապված այլ միջոցառումներին ներկայացվող պահանջները և կիրառման պայմանները, ակցիայի մասին իրազեկմանը ներկայացվող պահանջները, մասնավորապես՝ ակցիայի վերաբերյալ տեղեկատվության հրապարակման, դրա դադարեցման պայմանները և այլն, օրենքին հակասող ակցիա իրականացնելու համար նախատեսվող իրավական հետևանքները։
