Ի վերջո ի՞նչ էին փորձում այսօր ԱԺ-ում հասկացնել առողջապահության փոխտեսուչ Լենա Նանուշյանին, ով դեմագոգիայի մինչև օրս չգերազանցված նշաձող սահմանեց:
Այսպես,
ԵԱՏՄ պայմանագրի 52-րդ հոդվածով սահմանված է, որ Միության տեխնիկական կանոնակարգերը կամ պարտադիր ազգային պահանջները գործում են միայն այն արտադրանքի նկատմամբ, որոնք ընդգրկված են ԵԱՏՄ Միասնական ցանկում: Նույն հոդվածով անդամ պետություններին թույլ չի տրվում իրենց օրենսդրությամբ սահմանել Միասնական ցանկում չընդգրկված արտադրանքին առնչվող պարտադիր պահանջներ։
Ըստ պայմանագրի 53-րդ հոդվածի անդամ պետություններն իրենց տարածքում ապահովում են Միության տեխնիկական կանոնակարգի պահանջներին համապատասխանող արտադրանքի շրջանառությունը՝ առանց Միության տեխնիկական կանոնակարգում ներառված այդ արտադրանքին ներկայացվող պահանջներից բացի լրացուցիչ պահանջներ ներկայացնելու և առանց իրականացնելու համապատասխանության գնահատման լրացուցիչ ընթացակարգեր։ Նիկոտին պարունակող արտադրատեսակների կարգավորման ԵԱՏՄ տեխնիկական կանոնակարգով հստակ սահմանվում է, որ այն չի տարածվում ծխախոտային, այսինքն ամբողջությամբ կամ մասամբ ծխախոտային տերևից պատրաստված արտադրատեսակների վրա, իսկ նիկոտին պարունակող արտադրատեսակների շարքում թվարկված են մի շարք այնպիսիք, ինչպիսիք տեղական օրենսդրությամբ դասվում են ծխախոտային արտադրատեսակների շարքին, օրինակ ըստ ԵԱՏՄ
իրավակարգավորումների տաքացվող ծխախոտը նիկոտին պարունակող արտադրատեսակ, սակայն ծխախոտային արտադրատեսակ չէ։
 
ԵԱՏՄ տեխնիկական կանոնակարգը նաև տարանջատում է ծխել և տաքացնել հասկացությունները և ըստ դրա, այնպիսի արտադրատեսակները, որոնք չեն տաքացվում, այլ ծխում են, դուրս է թողնում իր կարգավորման շրջանակներից, պատկերը սակայն հակառակն է տեղական օրենսդրությունում։
 
Այսպիսով, տեղական օրենսդրությամբ ծխախոտային արտադրատեսակի և դրա փոխարինիչների համար տրված սահմանումներն իրենց շրջանակներն ընդգրկող արտադրատեսակների առումով շոշափելիորեն հակասում են ԵԱՏՄ իրավակարգավորումներին։ Սա իր հերթին նշանակում է, որ այսօր հնարավոր
է վարչարարություն կիրառենք այնպիսի արտադրատեսակ կիրառող անձի նկատմամբ, հետևաբար նաև այն տարածքը տնօրինող տնտեսվարողի նկատմամբ, որի տարածքում կիրառվում է այդ արտադրատեսակը, ինչպիսի արտադրատեսակը ԵԱՏՄ մակարդակով հակածխախոտային քաղաքականության առարկա չի հանդիսանում։
