Շատերս ենք հիշում, որ Կարեն Անդրեասյանը պաշտոնը ստանձնելուց հետո շտապեց շարունակել իրեն նախորդող նախարարի այդպես էլ չիրագործված աշխատանքը, կամ, ավելի ճիշտ, Նիկոլ Փաշինյանի հանձնարարականը՝ դատական համակարգի վեթինգի իրականացումը։

Դեռևս նախորդ տարվա դեկտեմբերին Անդրեասյանը ներկայացրեց դատական համակարգի վեթինգի նոր նախագիծ։ Նախագծով առաջարկվում էր դատավորի, այդ թվում՝ նաև ՍԴ դատավորի, լիազորությունները դադարեցնել, եթե վերջինս միտումնավոր թույլ է տվել մարդու հիմնարար իրավունքի կոպիտ խախտում։

Ըստ էության, ներկայացված նախագծի փաթեթի անգամ հպանցիկ ուսումնասիրությունը բավական է հասկանալու համար, որ այս անգամ էլ չեն արդարացվելու հասարակության՝ անկախ դատական համակարգ ունենալու հույսերը, իսկ մյուս կողմից էլ՝ ի հայտ են գալու դատական իշխանության անկախության վրա ազդող նոր սպառնալիքներ։ Նախ, նախագծում կիրառված է «դատավորի պաշտոնի անհամատեղելիություն» եզրույթը, որն ինքնին այլ իմաստ ունի և վերաբերում է դատավորի պաշտոնի հետ միաժամանակ այլ աշխատանքով զբաղվելու արգելքին։ Եթե խոսենք դատավորին իր իսկ կողմից թույլ տված մասնագիտական սխալի դիմաց պատժելու մասին, ապա դրա համար արդեն իսկ գործում է Դատական օրենսգրքի համապատասխան դրույթը, որով նախատեսված է համանման կարգավորում։

Կարևոր է փաստել, որ Անդրեասյանը, միմյանց հակասող տարատեսակ դրույթներ պարունակող և, ամենակարևորը, դատական համակարգին միայն վնասող իր ներկայացրած այդ նախագիծը հանրային քննարկմանը ներկայացնելուց երկու օր անց՝ դեկտեմբերի 16-ին, շնչակտուր ուղարկել է Վենետիկի հանձնաժողով` կարծիք ստանալու խնդրանքով:  Վենետիկի հանձնաժողովն իր կարծիքը հրապարակեց օրերս՝ մարտի 21-ին, ընդ որում, հայտնեց այնպիսի կարծիք, որը միանշանակ այնպիսին չէր, ինչպիսին կցանկանար ստանալ Անդրեասյանը։

Ըստ այդմ՝ Վենետիկի հանձնաժողովն իր մտահոգություններն է հայտնել նախարարության կողմից ներկայացված այս նախագծի վերաբերյալ՝ նշելով, որ հանձնաժողովը չի տեսնում առաջարկվող նախագծի անհրաժեշտությունը, քանի որ և՛ գործող, և՛ շուտով ուժի մեջ մտնող քրեական օրենսգրքերով արդեն իսկ նախատեսված են կարգավորումներ, որոնք քրեական պատասխանատվություն են սահմանում ակնհայտ անարդար դատավճռի համար: Բացի այդ, Վենետիկի հանձնաժողովն ընդգծել է, թե ինչքանով կարող է «միտումնավոր խախտում» կատարած լինելու փաստը դիտարկվել՝ որպես անհամատեղելիության պահանջի խախտում, այն դեպքում, երբ անհամատեղելիության պահանջը ենթադրում է դատավորի պաշտոնի հետ անհամատեղելի այլ գործունեությամբ զբաղվելու արգելք:

Եթե սա ներկայացնենք ավելի լայն բացվածքով, ապա Վենետիկի հանձնաժողովի կողմից բարձրացված հարցերի արդյունքում հարցականի տակ է դրվում ներկայացված նախագծի ամբողջ տրամաբանությունը, ասել է թե՝ դատական համակարգի վեթինգի գաղափարը։ Այս ամենի մեջ առավել հետաքրքրական է, թե Վենետիկի հանձնաժողովի կողմից հրապարակված կարծիքին ինչպես կարձագանքի արդարադատության նախարարությունն ու իշխող քաղաքական ուժը. կընտրեն բառախաղի միջոցով բուն բովանդակությունը խեղաթյուրելու և դրական լույսի ներքո ներկայացնելու տրամաբանությո՞ւնը, թե՞ պարզապես կանտեսեն այս կարծիքը և կշարունակեն դատական համակարգի անկախության նկատմամբ ոտնձգությունների շարքը։
