«Փաստ» օրաթերթը գրում է

Արդարադատության նախարարությունն առաջարկում է փոփոխություններ և լրացումներ կատարել կառավարության 2021 թ.-ի մայիսի 13-ի թիվ 779-Ն որոշման մեջ: Այդ որոշմամբ ապոստիլով վավերացվող պաշտոնական փաստաթղթեր տրամադրող վարչական և այլ մարմինների համար սահմանվել է պարտավորություն՝ արդարադատության նախարարությանը պաշտոնական փաստաթղթերի ձևանմուշները, դրանք կազմող անձանց վերաբերյալ տեղեկությունները, ստորագրության և պաշտոնական փաստաթուղթը հաստատող կնիքի, դրոշմակնիքի նմուշները (վավերապայմաններ) տրամադրելու մասին:

Նշված որոշմամբ, հաստատված կարգի համաձայն, պաշտոնական փաստաթուղթը ապոստիլով վավերացնելու գործընթացի ընթացքում անհրաժեշտ վավերապայմանների բացակայության և փաստաթղթի իսկության ստուգման անհրաժեշտության դեպքում Արդարադատության նախարարությունը հարցում է կատարում պաշտոնական փաստաթուղթ տրամադրող մարմնին կամ անձին: Նախագծի հիմնավորման մեջ նախարարությունը նշում է, որ ապոստիլով վավերացվող պաշտոնական փաստաթղթերի շրջանակում ներառված են նաև ՀՀ ուսումնական և բժշկական օգնություն և սպասարկում իրականացնող հաստատությունների կողմից տրամադրվող փաստաթղթերը:

Նշված հաստատություններից անհրաժեշտ վավերապայմանների կամ իսկության վերաբերյալ տեղեկություններ ստանալու նպատակով Արդարադատության նախարարությունը դիմում է պետական կառավարման այն մարմնին, որի ենթակայության ներքո գտնվում են ուսումնական կամ բժշկական հաստատությունները կամ փոխօգնության կարգով՝ համապատասխան գերատեսչությանը: Փաստաթուղթը տրամադրած ուսումնական կամ բժշկական հաստատությանն անմիջական հարցումներ կատարելու լիազորություն Արդարադատության նախարարությանը վերապահված չէ: Ստեղծված իրավիճակն արհեստականորեն երկարաձգում է պաշտոնական փաստաթուղթն ապոստիլով վավերացնելու գործընթացը՝ հայցվող տեղեկությունների ստացմանը երկու և ավելի մարմիններ ներգրավվելու պատճառով:

Հարցումները կատարվում են փաստաթղթաշրջանառության էլեկտրոնային միասնական համակարգի, իսկ դրան համակցված չլինելու դեպքում՝ փոստային ծառայության միջոցով, որը նույնպես գործընթացի երկարաձգման պատճառ է դառնում: Առաջարկվող լրացումները հնարավորություն կընձեռեն Արդարադատության նախարարությանն անմիջականորեն դիմել հայցվող մարմիններին կամ անձանց (ստորաբաժանումներին, իրավաբանական անձանց և այլն)` չծանրաբեռնելով համապատասխան գերատեսչություններին լրացուցիչ, միջնորդավորված վարչարարությամբ:

Էլեկտրոնային փոստի միջոցով հարցումներ կատարելը և պատասխաններ ստանալը երաշխավորելու է ապոստիլի վավերացման արագ գործընթացի կազմակերպումը և քաղաքացիների սպասարկումը: Նախագծում տեղ են գտել նաև այլ փոփոխություններ և լրացումներ, որոնք կրում են հստակեցման բնույթ:
