Վերաքննիչ քրեական դատարանը՝ դատավոր Արմեն Դանիելյանի նախագահությամբ, մերժել է «ԱՐԱՐ» հիմնադրամի համահիմնադիր, հասարակական-քաղաքական գործիչ Ավետիք Չալաբյանի խափանման միջոցը փոփոխելու միջնորդությունը։ Չալաբյանի փաստաբանները հայտնել էին, որ բավական դրական տպավորություններ են ստացել դատական ընթացքից, ներկայացրել են իրենց փաստարկները, որ Ավետիք Չալաբյանին կալանքի տակ պահելը ապօրինի է և քաղաքական ենթատեքստ ունի, որից հետո դատավորը գնացել էր խորհրդակցական սենյակ։

Դատավոր Արմեն Դանիելյանը բազմիցս է ապացուցել, որ ծառայում է օրվա իշխանություններին։ Նախկին իշխանությունների օրոք նա ջերմեռանդ դակում էր բոլոր հրահանգները, նույնն էլ այժմ անում է Նիկոլ Փաշինյանի օրոք։ Փաստաբաններն արձանագրում են, որ սրանով պայքարը չի ավարտվելու, և իրենք պայքարելու ու հասնելու են Ավետիք Չալաբյանի ազատ արձակմանը։

Ըստ էության, գործ ունենք մի իրավիճակի հետ, երբ ինքն իրեն ժողովրդավար հռչակած պետությունը վերածվել է հակաժողովրդավար և արդարությունից զուրկ հասարակարգի։ Ինչևէ, Ավետիք Չալաբյանն ի վերջո դուրս է գալու, սակայն Հայաստանի Հանրապետության վարկին, հեղինակությանը, արդարադատության համակարգին հասցված այն ահռելի վնասը, որ արել է Նիկոլ Փաշինյանը, եթե ոչ անդառնալի, ապա շատ դժվար վերականգնելի է։ Այդուհանդերձ, նույնիսկ ամենածայրահեղ և անելանելի իրավիճակներից կա ելքը։
