«Փաստ» օրաթերթը գրում է

Մի քանի օր է, ինչ որոշակի շրջանակներ ինտենսիվորեն քննարկում են ԲԴԽ կողմից Մնացական Մարտիրոսյանին (Մացո) նորաստեղծ Հակակոռուպցիոն դատարանի դատավոր ընտրելը: Վերջին խոսքն, իհարկե, ՀՀ նախագահինն է, բայց ԲԴԽ նման որոշումն ինքնին ուշագրավ ենթատեքստեր ունի: Բանն այն է, որ Մարտիրոսյանը հայտնի է մի կողմից՝ որպես Եվրոպական դատարանի վճիռներով խախտումներ թույլ տված դատավոր, մյուս կողմից՝ միշտ իշխանահաճո որոշումներ կայացրած և քաղաքական աղմկահարույց գործերով, մեղմ ասած, կասկածելի որոշումներ կայացրած դատավոր:

Ի դեպ, նա այն քիչ դատավորներից է, որ 2018 թվականի իշխանափոխությունից հետո էլ դարձավ այս իշխանության «սրտի» դատավորը, որին հանձնարարվում էին քաղաքական ենթատեքստ ունեցող գործեր, այդ թվում՝ ռեժիսոր Արմեն Գրիգորյանի, հասարակական գործիչ Ավետիք Չալաբյանի և այլն: Ուշագրավ է, որ նրա թեկնածության հետ կապված բացասական եզրակացություն են տվել թե՛ փորձագետները, այդ թվում՝ միջազգային, թե՛ Կոռուպցիայի կանխարգելման հանձնաժողովը: Այդուամենայնիվ, ԲԴԽ-ն 6 կողմ և 3 դեմ ձայնով ընտրել է Մարտիրոսյանին: Դեմ քվեարկածների թվում է եղել նաև ԲԴԽ նախագահ Կարեն Անդրեասյանը:

Ի դեպ, դեռևս օգոստոսին արդարադատության նախարար եղած ժամանակ վերջինս Մնացական Մարտիրոսյանին կարգապահական պատասխանատվության ենթարկելու վերաբերյալ միջնորդություն էր ներկայացրել Բարձրագույն դատական խորհուրդ։ «Փաստ» թերթի տեղեկություններով, Մնացական Մարտիրոսյանի ընտրությունը Նիկոլ Փաշինյանի սրտով է, որը ժամանակին ասում էր, թե «Մարդու իրավունքների եվրոպական դատարանի որոշումներով հաստատված՝ քաղաքացիների իրավունքների կոպիտ խախտումներով դատավճիռների հեղինակ բոլոր դատավորները պետք է հրաժարական տան, հեռանան կամ հեռացվեն պաշտոններից»:

Սակայն, մեր աղբյուրների փոխանցմամբ, հիմա հենց նրա անունից է ԲԴԽ անդամների հետ «ինստրուկտաժ» արվել, որպեսզի կողմ քվեարկեն: Մեր տեղեկություններով, այս «բոլոլայի» արդյունքում բավական սրվել են Փաշինյանի ու ԲԴԽ նախագահի հարաբերությունները: Ի դեպ, ուշագրավ է, որ Փաշինյանի «սրտի» դատավորի ընտրության հետ կապված հատկապես մեծ աղմուկ են բարձրացրել, այսպես կոչված, «սորոսական» շրջանակները, որոնց առանձին միավորներ նույնիսկ պահանջ են ներկայացրել ՀՀ նախագահին՝ չհաստատել Մարտիրոսյանի թեկնածությունը:
