ՀՀ մարդու իրավունքների պաշտպանը տարածել է հայտարարությունն Ադրբեջանի զինված ուժերի կողմից ՀՀ ինքնիշխան տարածքից գերեվարված երկու հայ զինծառայողների դատապարտման վերաբերյալ։

Հայտարարության մեջ մասնավորապես ասվում է.

«Ադրբեջանի ծանր հանցագործությունների դատարանն Ադրբեջանի զինված ուժերի կողմից ՀՀ ինքնիշխան տարածքից գերեվարված երկու հայ զինծառայողներին մեղավոր է ճանաչել Ադրբեջանի քրեական օրենսգրքի տարբեր հոդվածներ ենթադրաբար խախտելու համար և դատապարտել 11 տարի 6 ամիս ժամկետով ազատազրկման:

Համաձայն ծնողներից և հարազատներից ստացված տեղեկատվության՝ Հայաստանի զինված ուժերի զինծառայողներ Կարեն Աշոտի Ղազարյանը (ժամկետային զինծառայող) և Հարություն Յուրիկի Հովակիմյանը (պայմանագրային զինծառայող) 2023 թվականի մայիսի 26-ին Հայաստանի Հանրապետության ինքնիշխան տարածքից գերեվարվել են ադրբեջանական զինուժի կողմից։

ՀՀ մարդու իրավունքների պաշտպանի աշխատակազմում ստացված տեղեկատվության համաձայն՝ երկու հայ զինծառայողները սնունդ և ջուր են տանելիս եղել ՀՀ Զինված ուժերի մարտական դիրքեր, և Ադրբեջանի զինված ուժերի զինծառայողների կողմից գերեվարվել են Հայաստանի Հանրապետության Ճակատեն և Շիկահող գյուղերի միջդիրքային ճանապարհից։

Այս առնչությամբ ՀՀ մարդու իրավունքների պաշտպան Անահիտ Մանասյանն ընդգծում է, որ Մարդու իրավունքների պաշտպանի աշխատակազմի կողմից գրանցված տեղեկատվությունը ցույց է տալիս, որ ադրբեջանական իշխանությունների գործողությունները` Հայաստանի Հանրապետության ինքնիշխան տարածքից հայ զինծառայողներին գերեվարելը, այնուհետև կեղծ մեղադրանքներ առաջադրելը և անարդար դատաքննության ենթարկելը՝ միջազգային իրավունքի, մարդու իրավունքների միջազգային իրավունքի և միջազգային մարդասիրական իրավունքի կոպիտ խախտումներ են։

Այս գործողությունները հակասում են Միավորված ազգերի կազմակերպության կանոնադրությանը, Քաղաքացիական և քաղաքական իրավունքների մասին միջազգային դաշնագրին և միջազգային մարդասիրական իրավունքի, այդ թվում՝ Ժնևյան երրորդ կոնվենցիայի պահանջներին:

Զինծառայողները գերեվարվել են Հայաստանի Հանրապետության ինքնիշխան տարածքից չընդհատվող զինված հակամարտության ընթացքում։ Միջազգային մարդասիրական իրավունքը գործում է այսպիսի իրավիճակներում՝ անկախ ընդհարման պատճառներից կամ ինտենսիվության մակարդակից։

Ավելին, Ադրբեջանի իշխանությունների կողմից քարոզվող հայատյացության քաղաքականությունը ևս մեկ ապացույց է քրեական դատավարության անօրինականության վերաբերյալ։ Ակնհայտ է, որ այս պայմաններում վտանգված են հայ ռազմագերիների հիմնարար իրավունքները։

Մարդու իրավունքների պաշտպանն ընդգծում է, որ Ադրբեջանում պահվող հայ գերիները գտնվում են խոշտանգումների, արժանապատվությունը նվաստացնող և անմարդկային վերաբերմունքի մշտական վտանգի ներքո, ինչի մասին են վկայում Մարդու իրավունքների պաշտպանի աշխատակազմի կողմից արձանագրած տեղեկությունները։

Մարդու իրավունքների պաշտպանի աշխատակազմն ուսումնասիրում և ամփոփում է վերոնշյալ տեղեկատվությունը և ներկայացնելու է միջազգային կազմակերպություններին և այլ դերակատարներին, ինչպես նաև պետական իրավասու մարմիններին»։
