Հրաձգային գումարտակի հրամանատարի տեղակալ Մ.Պ.-ն, 2020 թվականի սեպտեմբերի 27-ին` Կառավարության կողմից հայտարարված ռազմական դրության ժամանակ, հակառակորդի առաջխաղացումը կասեցնելու և տարածումը կանխելու փոխարեն, մարտական դիրքի անձնակազմի մոտ խուճապ է տարածել և հրամայել նահանջել:

Այս մասին հայտնում են Գլխավոր դատախազությունից։

Մասնավորապես՝ գումարտակի հրամանատարի տեղակալ Մ.Պ.-ն, դեռևս 2020 թվականի սեպտեմբերի 26-ին, նշանակված լինելով որպես N զորամասի պահպանության տեղամասի մարտական դիրքի պատասխանատու, սեպտեմբերի 28-ին խնդիր է ստացել իրականացնել Արցախի Հանրապետության շփման գծի ու օդային տարածության պահպանությունը, կանխել սահմանի խախտումը: 

Նույն օրը՝ ժամը 14:00-ի սահմաններում, տեղեկանալով, որ ադրբեջանական զինված ուժերը ճեղքել են իր պաշտպանության տեղամասի հարևանությամբ գտնվող ՊԲ N զորամասի պաշտպանական բնագիծը՝ Արցախի Հանրապետության Մարտակերտի շրջանի Թալիշ բնակավայրի ուղղությունից, պարտավոր լինելով կասեցնել հակառակորդի առաջխաղացումը, ստորաբաժանման նահանջն իրականացնել կազմակերպված ու գաղտնի՝ անտեսելով մարտական դիրքերը և զբաղեցրած բնագիծն անպաշտպան թողնելու հանգամանքը, դրսևորել է անգործություն և կատարել իշխանազանցություն: Մասնավորապես՝ չունենալով զբաղեցրած N մարտական դիրքից նահանջելու վերաբերյալ գումարտակի հրամանատարի հրամանը՝ մարտական դիրքի անձնակազմի մոտ խուճապ է տարածել՝ հայտնելով, որ դիտարկվել են հակառակորդի տանկեր, որոնք հասնելու են իրենց ու ոչնչացնեն: Այնուհետև, հրամայել է անմիջապես նահանջել և, առանց մարտ վարելու, դիրքի ամբողջ անձնակազմի հետ լքել է մարտական դիրքը և նահանջել:

Արդյունքում՝ հակառակորդն անխոչընդոտ առաջացել և վերահսկողության տակ է վերցրել մարտական դիրքերը:

2023 թվականի հունիսի 2-ին հսկող դատախազը հանրային քրեական հետապնդում է հարուցել Մ.Պ.-ի նկատմամբ՝ 18.04.2003 թվականին ընդունված Քրեական օրենսգրքի 375-րդ հոդվածի 4-րդ մասով (իշխանությունը չարաշահելը, իշխանազանցությունը կամ իշխանության անգործությունը)։ 

2023 թվականի հուլիսի 7-ին դատախազը քրեական վարույթի նյութերը մեղադրական եզրակացությամբ հանձնել է Սյունիքի մարզի առաջին ատյանի ընդհանուր իրավասության քրեական դատարան։ 

Ծանուցում. հանցագործության համար մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
