Տիգրան Ավինյանը ոչ իրավաչափորեն է ստանձնել Երևանի քաղաքապետի լիազորությունները

«Մայր Հայաստան» դաշինքի որոշմամբ դատական հայց եմ ներկայացրել Երևանի քաղաքապետի լիազորությունները ոչ իրավաչափորեն ստանձնած Տիգրան Ավինյանի դեմ:
 
1. Ըստ ԿԸՀ-ի՝ Երևանի ավագանու ընտրություններից հետո Տիգրան Ավինյանի գլխավորած ՔՊԿ-ն ստացել էր ընտրության մասնակիցների 32,6 տոկոսը՝ ընտրական իրավունք ունեցողների 9,1 տոկոսը: Սա նշանակում է, որ Ավինյանի քաղաքապետությունը լեգիտիմության առումով կաղում է, բայց սա դեռ մի կողմ դնենք:
2. ՔՊ ու «Հանրապետություն» խմբակցությունների կողմ ձայների ու «Հանրային ձայն» խմբակցության 5 անդամի կողմից Երևանի ավագանու նիստի քվորումի ապահովման միջոցով Տիգրան Ավինյանը դարձավ մայրաքաղաքի քաղաքապետ (ավագանու ընդհանուր թվի՝ 65, կեսից պակաս՝ 32 ձայնով): Սա էլ մի կողմ դնենք:
3. Օրենքը պահանջում է, որ քաղաքապետն իր ընտրվելուց հետո 3-րդ օրացուցային օրը լիազորությունները պետք է ստանձնի օրենքի ուժով հրավիրված Երևանի ավագանու նիստում: Այդ նիստը, սակայն, չի ունեցել անհրաժեշտ քվորումը (առնվազն 33 ավագանու մասնակցություն): Դա նշանակում է, որ Տիգրան Ավինյանն իր լիազորությունները ապօրինաբար է ստանձնել: Ուշագրավ է, որ հոկտեմբերի 13-ին տեղի ունեցած նիստի արձանագրությունները քաղաքապետարանը պատշաճ ձևով չի հանրայնացրել, այսինքն՝ չկան նիստի մասնակիցների անունները և նրանց քանակի մասին տեղեկությունները:
4. Վարչական դատարանից մեր պահանջն այն է, որ Երևանի քաղաքապետի լիազորությունների ստանձնման ավագանու նիստը պետք է համապատասխանի օրենքին, այսինքն՝ Երևանի ավագանին պարտավոր է կրկին անցկացնել քաղաքապետի երդման արարողությունը, քանզի հակառակ պարագայում Տիգրան Ավինյանի գործողությունները քաղաքապետի պաշտոնում կլինեն իրավազանց՝ լիազորությունների ստանձնման ոչ իրավաչափության հիմքով (երդման արարողության համար ծախսված հսկայական գումարների թեման էլ ենք մի կողմ դնում):
5. Եթե օրենքի ուժով ավագանու իրավաչափ նիստ տեղի չունենա, ապա օրենքի տառից ու ոգուց բխում է, որ Երևանում պետք է տեղի ունենա նոր ընտրություն, ինչից ՔՊԿ-ն ու նրան սատարողները խուսափում են: Ի դեպ, երդման արարողության գործընթացի օրենքով սահմանված կարգով չանցկացման արդյունքում նոր ընտրության նշանակման նախադեպ կա (Թալինում):
