«Հայաքվե» նախաձեռնող խմբի համակարգող, հասարակական-քաղաքական գործիչ Ավետիք Չալաբյանը ֆեյսբուքյան իր էջում գրում է․

Հոկտեմբերի 24-ին Ազգային ժողովի ՔՊ խմբակցությունը, նույն ԱԺ կանոնակարգի խախտմամբ, առաջին ընթերցմամբ ընդունել է ՀՀ "Ընտրական օրենսգրքում" փոփոխությունների նախագիծը։ Այն ծավալուն փաստաթուղթ է, և բազմաթիվ խնդիրներ ունի, բայց դրանցից մեկը պարզապես աչք է ծակում իր բովանդակությամբ։

Օրենսգիրքը լրացված է ծավալուն նոր հոդվածով (7.1), որը մանրամասնում է ռազմական կամ արտագարգ դրության դեպքում ընտրական գործընթացի սահմանափակումները։ Նրա 3-րդ մասում կա այսպիսի զարմանահրաշ ձևակերպում՝ "Եթե ռազմական կամ արտակարգ դրությունը հայտարարվել է Ազգային ժողովի կամ տեղական ինքնակառավարման մարմինների ընտրությունների թեկնածուներ առաջադրելու համար նախատեսված ժամկետի սկսվելուց հետո մինչեւ ընտրությունների քվեարկության նախնական արդյունքները ամփոփելու եւ դրանք արձանագրությամբ վավերացնելու պահը, ապա ռազմական կամ արտակարգ դրություն հայտարարվելու պահից ընտրական գործընթացն իրավունքի ուժով համարվում է կասեցված, որից հետո ընտրական գործընթացի վերսկսումը պարտադիր ենթադրում է ՆՈՐ ՔՎԵԱՐԿՈՒԹՅԱՆ կազմակերպում եւ անցկացում:"

Փաստացի ստացվում է, որ եթե ընտրական գործընթացի արդյունքում, ներկայիս թրքամետ իշխանությունը պարտություն կրի, այն կարող է անմիջապես ահազնանգել Բաքվում և Անկարայում իր գործընկերներին, և նրանք էլ, "ռևանշիստների" իշխանության գալը կանխելու պատրվակով, ռազմական գործողություններ սկսեն Հայաստանի դեմ։ Այս պայմաններում գործող իշխանությունը հայտարարում է ռազմական դրություն, չեղարկում է ընտրությունների փաստացի արդյունքները, և նոր քվեարկություն է անցկացնում արդեն Բաքվի ուժային ճնշման ներքո, ժողովրդին համոզելով, որ եթե չեք ցանկանում նոր պատերազմ, պետք է ստիպված ինձ ընտրեք։

Եթե ոմանց կթվա, որ սա երևակայության ժանրից է, խորհուրդ կտամ ուշադիր կարդալ հղման վերջին նախադասությունը, և փորձել պատասխանել այն հարցին, թե ինչու պետք է ընտրական գործընթացի կասեցումից հետո նոր քվեարկություն անցկացվի, եթե պարզապես կարելի է ռազմական դրության ավարտից հետո վավերացնել արդեն կայացած քվեարկության արդյունքները։

Հաշվի առնելով, որ ՔՊ մեծամասնությունը ոչ մի բանի առաջ չի կանգնի սեփական իշխանությունը երկարաձգելու համար, նրանց կողմից թշնամու զորքերը երկիր հրավիրելը լրիվ հավանական տարբերակ է։ Եթե այդպես չի, թող ապացուցեն հակառակը, և երկրորդ ընթերցմամբ այս նախադասությունը հանեն օրենքից, դա լրիվ իրենց իրավասության մեջ է։ Ինչ վերաբերվում է ԱԺ ընդդիմությանը, կարծում եմ, որ նրա կողմից առաջնահերթ կարգով այս փոփոխությունները պետք է բողոքարկվեն Սահմանադրական դատարանում, թեև նրանից մեծ սպասելիքներ ևս չկան։
