ԵԱՏՄ անդամ չհանդիսացող պետությունում գրանցված անձնական օգտագործման տրանսպորտային միջոցների ժամանակավոր ներմուծումը ՀՀ թույլատրվում է ոչ ավելի, քան 1 տարի ժամկետով

Պետական եկամուտների կոմիտեն, հաշվի առնելով հանրային հետաքրքրությունը՝ ֆիզիկական անձանց կողմից ԵԱՏՄ անդամ չհանդիսացող պետություններում գրանցված անձնական օգտագործման տրանսպորտային միջոցների ժամանակավոր ներմուծման վերաբերյալ, հիշեցնում է, որ այդ տրանսպորտային միջոցները Հայաստան ներմուծվում են ԵԱՏՄ մաքսային օրենսգրքի իրավական կարգավորումների համաձայն։  

«Օտարերկրյա ֆիզիկական անձանց, ինչպես նաև ԵԱՏՄ անդամ պետությունների ֆիզիկական անձանց կողմից ԵԱՏՄ անդամ չհանդիսացող պետությունում գրանցված անձնական օգտագործման տրանսպորտային միջոցների ժամանակավոր ներմուծումը Միության մաքսային տարածք, այս դեպքում՝ Հայաստանի Հանրապետություն, թույլատրվում է ոչ ավելի, քան 1 տարի ժամկետով: Այս դեպքում տրանսպորտային միջոցների ժամանակավոր ներմուծման այլ ժամկետներ սահմանող իրավական որևէ այլ կարգավորում ներկայում չկա»,-նշված է ՊԵԿ-ի տարածած հաղորդագրության մեջ: 

Միաժամանակ, Կոմիտեից հայտնում են, որ անձնական օգտագործման տրանսպորտային միջոցներ ներմուծողներին օրենսդրությունը տարանջատում է ոչ թե Հայաստանի Հանրապետության կամ օտարերկրյա քաղաքացիություն ունենալու, այլ «միության անձ» կամ «օտարերկրյա անձ» լինեու հանգամանքով։ Եթե ֆիզիկական անձը Միության մաքսային տարածքում, այս դեպքում՝ Հայաստանում ունի մշտական բնակության վայր, ապա համարվում է «միության անձ»։ Հակառակ պարագայում, այսինքն, ԵԱՏՄ-ում, այդ թվում՝ ՀՀ-ում մշտական բնակության վայր չունենալու դեպքում, անկախ ՀՀ քաղաքացիություն ունենալու կամ չունենալու հանգամանքից, ֆիզիկական անձը համարվում է «օտարերկրյա անձ»:

ՊԵԿ-ից հայտնում են, որ «միության անձը» ժամանակավորապես ներմուծվող տրանսպորտային միջոցի համար առաջացող մաքսատուրքերի և հարկերի վճարման պարտավորությունը պետք է ապահովի միշտ։ Իսկ «օտարերկրյա անձանց» համար 1-ին տրանսպորտային միջոցի ներմուծման համար այդպիսի պահանջ չի սահմանվում։  Սակայն վերջիններիս համար այդ պարտավորությունը կառաջանա, երբ առանց այդ տրանսպորտային միջոցը վերաարտահանելու՝ ժամանակավորապես կներմուծի 2-րդ և յուրաքանչյուր հաջորդ տրանսպորտային միջոցը։

«Օտարերկրյա անձը» նաև նման պարտավորություն կունենա մշտական բնակության նպատակով ՀՀ ժամանելու դեպքում։ Տեղեկացվում է, որ Կառավարության 2023 թ․ նոյեմբերի 30-ի N 2060-Ն որոշմամբ ՀՀ ներմուծվող անձնական օգտագործման տրանսպորտային միջոցների համար մաքսատուրքերի և հարկերի վճարման պարտավորությունն ապահովվում է դրամական միջոցներով։ Միաժամանակ, սահմանված վճարման պարտավորությունների ապահովման չափը կարգավորված է ԵԱՏՄ մաքսային օրենսգրքի 271-րդ հոդվածի 6-րդ կետով։     

Կոմիտեի ուսումնասիրությունները ցույց են տալիս, որ լինում են դեպքեր, երբ օտարերկրյա պետությունում գրանցված տրանսպորտային միջոցը սկզբնապես ներմուծվելով օտարերկրյա անձի կողմից` շահագործման նպատակով հանձնվում է այլ անձանց (այդ թվում` ՀՀ-ում մշտական բնակության վայր ունեցող քաղաքացիներին) և, միաժամանակ, ներմուծումն իրականացրած օտարերկրյա անձը լքում է երկիրը` այդպիսով շրջանցելով վճարումն ապահովելու պահանջը:

Կոմիտեն հորդորում է քաղաքացիներին զերծ մնալ նման վարքագծից, քանի որ ՀՀ սահմանը հատելու պահից այդպիսի տրանսպորտային միջոցը գտնվում է մաքսային հսկողության ներքո և ՀՀ-ում պետք է գտնվի հայտարարատուի (ներմուծողի) փաստացի տիրապետման և օգտագործման տակ։ Այսինքն, չի կարող փոխանցվել այլ անձի, բացառությամբ՝ օրենսդրությամբ սահմանված դեպքերի:

ՊԵԿ-ը հայտնում է, որ «Մաքսային կարգավորման մասին» ՀՀ օրենքի 308-րդ հոդվածի 2-րդ մասով սահմանված է պատասխանատվություն․ ֆիզիկական անձանց կողմից մաքսային հսկողության ներքո գտնվող անձնական օգտագործման տրանսպորտային միջոցներն առանց մաքսային մարմնի գրավոր թույլտվության հանձնելն առաջացնում է տուգանք` այդ տրանսպորտային միջոցների մաքսային արժեքի 20 տոկոսի չափով:
