Հրայր Կամենդատյանը ֆեյսբուքյան իր էջում գրում է.

Այսօր նույն մեխանիզմն է գործի դրվում նաև մեր տարածաշրջանում։ Խաղաղության կեղծ թղթեր, կնքված պարտվողների սեղաններին, որոնք չունեն ո՛չ միջազգային երաշխիք, ո՛չ տնտեսական հիմնավորում, ո՛չ էլ ազգային արժանապատվություն։ Դրանք ստորագրվում են միայն իշխանություն պահելու դիմաց։

Չորս տարի առաջ էլ «խաղաղություն» էին խոստանում աֆղանցիներին, այսօր էլ մեզ են խաբում «միջանցք» ասվածով, որն իրականում Հայաստանի տարածքային ամբողջականության դեմ ուղղված ծրագիր է։

Թրամփը, Բայդենը, ով էլ լինի, չորս տարի անց իր ծրագրերը դեն է նետելու՝ ինչպես եղավ Աֆղանստանում, Իրաքում, Սիրիայում։ Իսկ Հայաստանի վրա կմնա ստորացված քարտեզ ու նոր պատերազմ՝ այս անգամ արդեն Սյունիքում։

Թե ինչու է հիմա Հայաստանը համաձայնություն տալիս միջանցքի, հարց է, որ ուղղակի ապշեցնող է։ Եթե համաձայն էինք «հորիզոնական կապի» գաղափարին, ինչու ժամանակին չհաջողվեց դա անել՝ ունենալով մեր իսկ վերահսկողության ներքո գտնվող Լաչինի միջանցքը։ Որովհետև այդ պահին Արցախի տարածքը դեռ հայկական էր։ Հիմա՝ Արցախի հանձնմամբ և Լաչինի փակմամբ, միջանցքի տրամադրումը ոչ թե երկկողմ փոխանակում է, այլ մաքուր տարածքային զիջում։

Այսպես՝ Հայաստանի գործող իշխանությունը փաստացի հաստատեց, որ Արցախն այլևս Հայաստանի հետ կապ չունի, իսկ հիմա փորձում է նույն տրամաբանությամբ տարածք զիջել նաև Սյունիքում։

Խաղաղություն չեն բերում դրսից թելադրված թղթերը։ Դրանք բերում են նոր նվաստացում։

Այդ թղթերը՝ ինչպես Մյունխենի, Քեմփ Դեվիդի կամ Օսլոյի պայմանագրերը, միշտ վերանայվում են նոր իշխանությունների կողմից։ Նոր Հայաստանը պարտավոր է պատռել այս ստրկացուցիչ թղթերը և վերագծել մեր իրավունքների սահմանը՝ ոչ թե նվաստացած, այլ հաղթողի իրավունքով։

Թղթերով խաղաղություն չկա։Այսօր Հայաստանի իշխանությունները միջանցքի տրամադրման գաղափարը փաթեթավորում են որպես «տարածաշրջանային խաղաղություն»։ Բայց փաստացի դա Հայաստանի տարածքային ամբողջականության պառակտում է։

Ու այստեղ կա մեկ շատ կարևոր հանգամանք․

Հայաստանի օրենսդրությունն արգելում է հողերի վաճառքը ոչ ռեզիդենտներին։ Այսինքն՝ կառավարությունը իրավասու չէ միջպետական համաձայնագրերով փոխել կամ վաճառել ՀՀ հողը այլ երկրի օգտին։

Ավելին, ՀՀ Սահմանադրության 205-րդ հոդվածը հստակ սահմանում է․ եթե տարածքի օտարման կամ իրավական կարգավիճակի փոփոխության հարց է ծագում, ապա պարտադիր է հանրաքվե անցկացնել։

Միջանցք տրամադրելը հենց այդպիսի հարց է։ Դա տարածքի իրավական կարգավիճակի փոփոխություն է՝ լինի դա էքստրատերիտորիալություն, վերահսկողության փոխանցում կամ սահմանային ռեժիմի վերացում։

Իսկ եթե հանրաքվե չի եղել, ուրեմն միջանցքային բոլոր պայմանավորվածությունները ոչ միայն անօրինական են, այլև հակասահմանադրական։

Ու թող չփորձեն ժողովրդին խաբել «ճանապարհ» անվանումով։ Ճանապարհը բոլորի համար բաց է, բայց միջանցքը այլ բան է։ Դա ճանապարհ չէ, դա ներխուժման օրինականացման ձև է։

Եթե այս իշխանությունը հող է հանձնում առանց հանրաքվեի, ուրեմն խախտում է Սահմանադրությունը, ծառայում է այլ պետության շահերին և պետք է կրի օրենքի ողջ խստությամբ պատասխանատվություն։
