Ազդեցիկ գործարար և բարերար Սամվել Կարապետյանը արդեն ավելի քան երեք ամիս պահվում է կալանքի տակ՝ առանց օրինական հիմքերի։ Նրա փաստաբանների հայտարարության համաձայն՝ կալանքը ոչ միայն իրավական, այլև քաղաքական բնույթ է կրում, և բոլոր հանգամանքները վկայում են հետապնդման բացառապես քաղաքական դրդապատճառների մասին։

Կարապետյանը կալանավորվել է 2025 թվականի հունիսի 18-ին՝ «իշխանությունը բռնությամբ զավթելու կոչի» անհիմն մեղադրանքով։ Օգոստոսի 15-ին Հակակոռուպցիոն դատարանի դատավոր Տիգրան Դավթյանը կրկին երկու ամսով երկարաձգեց կալանքի ժամկետը՝ առանց որևէ իրավաչափ պատճառաբանության։ Դատարանի որոշման հիմքում դրվել էր միայն քննչականի «ակտիվ գործողությունների» խոստումը, մինչդեռ այդ խոստումները մինչ օրս որևէ գործողությամբ չեն հաստատվել։

Փաստաբանները ընդգծում են, որ քննիչ մարմինները անգամ չեն կարողացել ներկայացնել որևէ հիմնավոր կասկած փողերի լվացման կամ տնտեսական բնույթի ենթադրյալ արարքների վերաբերյալ։ Վերաքննիչ հակակոռուպցիոն դատարանն էլ, մերժելով ինչպես դատախազության, այնպես էլ պաշտպանական կողմի բողոքները, փաստացի հաստատել է այդ կասկածների բացակայությունը։ Սակայն այս ամենի ֆոնին Սամվել Կարապետյանը շարունակում է մնալ կալանքի տակ՝ խախտված անձնական ազատության և օրենքի տարրական երաշխիքների պայմաններում։

Փաստաբանական խումբը հատուկ շեշտում է, որ Կարապետյանի կալանավորման իրական պատճառը հունիսի 17-ին հնչեցրած նրա հրապարակային խոսքն էր, որով նա կոշտ քննադատել էր իշխանությունների վարքագիծը՝ Մայր Աթոռի և սահմանադրական երաշխիքների հանդեպ։ Այդ ելույթը ամբողջությամբ պաշտպանված է խոսքի ազատության իրավունքի ներքո, բայց հենց այն դարձավ գործարարի ազատազրկման պատճառ։

Այսօր արդեն ավելի քան 90 օր է, ինչ Սամվել Կարապետյանը գտնվում է կալանքի տակ, և ինչպես փաստաբանները հայտարարում են, նրա դեմ ընթացող գործընթացը ոչ մի աղերս չունի իրավունքի հետ։ Դա դասական քաղաքական հետապնդում է, որի մասին փաստերը, ըստ հայտարարության, անվիճելի են։

Փաստաբանների խումբը նաև տեղեկացնում է, որ արդեն ներկայացվել են վճռաբեկ բողոքներ և կատարվել են այլ դատավարական քայլեր։ Ապագայում հանրությունը կտեղեկացվի դրանց արդյունքների մասին։
