«Փաստ» օրաթերթը գրում է.

Աշխատանքի և սոցիալական հարցերի նախարարությունն առաջարկում է փոփոխություններ և լրացումներ կատարել կառավարության 2024 թվականի ապրիլի 4-ի N 479-Ն որոշման մեջ։ 2025 թվականի նոյեմբերի 29-ին ուժի մեջ է մտել «Երեխայի իրավունքների և երեխայի պաշտպանության համակարգի մասին» օրենքը, որը սահմանել է լիազորող նորմեր կառավարության որոշումներ ընդունելու համար: Այդ լիազորող նորմերից մեկը՝ նշված օրենքի 7-րդ հոդվածի 5-րդ մասն, ուղղակի ամրագրում է, որ բռնության ենթարկված երեխայի հայտնաբերման և համապատասխան մարմիններ պաշտպանության կամ աջակցության տրամադրման նպատակով նրա ուղղորդման կարգը, բռնության ենթարկված երեխային տրամադրվող աջակցության ձևերը և աջակցության տրամադրման կարգը սահմանում է կառավարությունը:

Դեպքի և բռնության ենթարկված անձի հայտնաբերումը և նրա մասին միջգերատեսչական տեղեկությունների փոխանակումն ապահովում է ուղղորդման գործընթացը: Մասնագետների միջամտության համար տեղեկատվության աղբյուր կարող են լինել երեխան, նրա ծնողները (ծնողներից մեկը) կամ օրինական ներկայացուցիչը, մասնագետը (դաստիարակ, ուսուցիչ, համայնքային և տարածքային մարմնի պատասխանատու, քաղաքացի), իսկ միջամտության առիթ կարող են լինել բուժզննման արդյունքները կամ որևէ այլ լրացուցիչ տեղեկություն:

Երեխաների կարիքների ընկալումը՝ նույնականացումը, գնահատումը և ուղղորդումը բազմամասնագիտական աշխատանք է, որը պահանջում է տարբեր մարմինների և ծառայությունների ջանքերի միավորում: Այս համատեղ աշխատանքը պետք է հիմնված լինի միասնական նպատակների և մոտեցումների վրա: Այդ նպատակով մի շարք երկրներում կիրառվում են երեխաների գործի վարման, ներառյալ հարցաքննության միասնական ուղեցույցներ, իսկ քննչական մարմինները կիրառում են այդ ուղեցույցների վրա հիմնված, իրենց ներքին կանոնակարգով սահմանված, երեխաների կարիքների գնահատման ընթացակարգ: Ընթացակարգի անհրաժեշտությունը պայմանավորված է նրանով, որ քննչական մարմնի կողմից երեխայի նախնական կարիքների գնահատումը թույլ կտա վեր հանել առավել հրատապ խնդիրները և դրանց համապատասխան ուղղորդումներ կատարել:

Նախագծով առաջարկվում է ներդնել բռնության ենթարկված երեխայի հայտնաբերման գործուն մեխանիզմ, ինչը կապահովի համապատասխան մարմիններ պաշտպանության կամ աջակցության տրամադրման նպատակով նրա ուղղորդման կարգի արդյունավետ իրականացումը, սահմանել բռնության ենթարկված երեխային տրամադրվող աջակցության ձևերը և դրանց տրամադրման առանձնահատկությունները՝ հիմք ընդունելով «Սոցիալական աջակցության մասին» նոր օրենքը, և հստակեցնել որոշման մեջ կիրառվող որոշ եզրույթներ և իրավական տեխնիկայի համատեքստում՝ համահնչությունն այլ իրավական ակտերի հետ:
