ՀՀ քննչական կոմիտեի Կոտայքի մարզային քննչական վարչությունում քննվող քրեական գործի նախաքննությամբ պարզվել է, որ Եղվարդի թիվ 1 մանկապարտեզում չեն պահպանվել սանիտարահամաճարակային կանոնները, ինչն էլ հանգեցրել է մանկապարտեզի տասնյակ սաների, ինչպես նաև աշխատակիցների և նրանց հետ շփվող մարդկանց շրջանում զանգվածային թունավորման։ Մասնավորապես, քննությամբ հիմնավորվել է, որ նշված նախադպրոցական հաստատությունում չեն պահպանվել «ՀՀ բնակչության սանիտարահամաճարակային անվտանգության մասին» ՀՀ օրենքով սահմանված սանիտարահամաճարակային կանոնները, դրանց պահպանման համար պատասխանատու անձանց կողմից դրսևորվել է հանցավոր անփութություն, չեն իրականացվել սանիտարահիգիենիկ ու հակահամաճարակային միջոցառումներ՝ շրջակա միջավայրի աղտոտման վերացման, կանխման, կենցաղի պայմանների բարելավման, ինչպես նաև հիվանդություն ների առաջացման և տարածման կանխարգելման ուղղությամբ:
Մանկապարտեզում խախտվել են նաեւ ՀՀ առողջապահության նախարարի՝ 2013 թվականի օգոստոսի 12-ի թիվ 42-Ն հրամանով հաստատված' նախադպրոցական ուսումնական հաստատություններում երեխաների սննդի կազմակերպմանը ներկայացվող հիգիենիկ պահանջները:
Արդյունքում' թիվ 1 մանկապարտեզի խոհանոցում ստեղծվել է հակասանիտարահամաճարակային իրավիճակ, որը նպաստել է մարդու օրգանիզմի վրա վտանգավոր գործոնների ազդեցությանը' անզգուշությամբ առաջացնելով մանկապարտեզի տասնյակ սաների, ինչպես նաև աշխատակիցների և նրանց հետ շփվող մարդկանց շրջանում զանգվածային թունավորման:
Քրեական գործով ձեռք բերված ապացույցների համակցությամբ' քննիչը որոշում է կայացրել Եղվարդի թիվ 1 մանկապարտեզ ՀՈԱԿ-ի տնօրեն Մ. Մանուկյանին և նույն մանկապարտեզի բուժքույր Ն. Առաքելյանին ՀՀ քրական օրենսգրքի 277-րդ հոդվածի առաջին մասով' Սանիտարահակահամաճարակային կանոնները խախտելը, որն անզգուշությամբ առաջացրել է մարդկանց զանգվածային հիվանդացում կամ թունավորում, որպես մեղադրյալ ներգրավելու մասին:
Ն. Առաքելյանը ներկայացել է վարույթն իրականացնող մարմնին, և դեկտեմբերի 16-ին նրան նշված հոդվածով մեղադրանք է առաջադրվել: Մանկապարտեզի տնօրենը չի ներկայացել վարույթ իրականացնող մարմնին՝ տրամադրելով ծանր հիվանդ լինելու վերաբերյալ բժշկական փաստաթղթեր: Մ. Մանուկյանի նկատմամբ նշանակվել է դատաբժշկական փորձաքննություն:
Միաժամանակ հանձնարարվել է պատկան կառույցներին' մանկապարտեզում իրականացնել համապատասխան ստուգումներ և միջոցներ ձեռնարկել՝ հակասանիտարահամաճարակային իրավիճակը վերացնելու ուղղությամբ, որից հետո մանկապարտեզը կվերսկսի իր բնականոն գործունեությունը:
