«Քրեական հեղիանկությունների» հնարվոր հավաքի մասին վերջին օրերին քննարկվող թեմայի շուրջ քննարկումներից մեկում մի գրառում արեցի, որը, ցավոք, տարընթերցումների տեղիք տվեց: Քննարկման մեջ գրել էի, որ եթե պահանջում եք արգելել «գողականներին» մուտք գործել Հայաստանի Հանրապետություն, ապա ի՞նչ անենք, արգելենք նաև համասեռամոլներին, այլ կրոնների հետևորդների՞ն: Իհարկե պարզ էր, որ խոսքս ուղղված էր այն անձանց, ովքեր կարծում են, թե հասարակական որևէ խմբի, համոզմունքների կամ այլ տարբերությունների համար հնարավոր է սահմանափակումներ կիրառել: Իրավական պետությունը պարտավոր է պաշտպանել յուրաքանչյուր անձի իրավունքներն ու ազատությունները: Որևէ դեպքում պետությունը չի կարող և, բարեբախտաբար, չի էլ սահմանում կամ կիրառում խտրականություններ: Այսպիսով, եթե անձը համասեռամոլ է, «գողական» կամ ունի այլ տարբերվող վարքագիծ, ապա արգելվում է խտրականություն դնել նրանց միջև, անկախ սեռական կողմնորոշումից, սեռից, սոցիալական ծագումից կամ այլ կարգավիճակներից: Յուրաքանչյուր ոք, անկախ թվարկված կարգավիճակներից ունի Սահմանադրությամբ ամրագրված հավասար իրավունքներ, ինչն էլ պաշտպանվում է պետության կողմից: Ինչպես ճիշտ նկատել է Աշոտ Ահարոնյանը, Հայաստանի Հանրապետությունը բաց երկիր է, որտեղ օրենսդրությամբ պաշտպանված են մարդու բոլոր իրավունքները, այդ թվում՝ ազատ տեղաշարժվելու և եթե անձը քրեորեն հետապնդելի արարք չի կատարել, ապա օգտվում է օրենսդրությամբ նախատեսված իր բոլոր իրավունքներից:
