ՀՀ հատուկ քննչական ծառայությունում ավարտվել է քաղաքացի Արթուր Կարապետյանի կողմից ՀՀ քննչական կոմիտեի Վայոց Ձորի քննչական վարչության ՀԿԳ ավագ քննիչ Հրաչյա Պողոսյանի նկատմամբ ակնհայտ սուտ մատնություն կատարելու դեպքի առթիվ ՀՀ քրեական օրենսգրքի 333-րդ հոդվածի 1-ին մասի հատկանիշներով հարուցված քրեական գործի նախաքննությունը:
Նախաքննությամբ պարզվել է, որ ՀՀ քննչական կոմիտեում խուլիգանության դեպքով քննվող քրեական գործի նախաքննության ընթացքում Ա. Կարապետյանը երկու անգամ որպես վկա հարցաքննվել է: Առաջին հարցաքննության ժամանակ Ա. Կարապետյանը ցուցմունք է տվել այն մասին, որ ականատես է եղել իր ընկերոջ ու քաղաքացիներ' ոմն Լազարի և Աշոտի վիճաբանությանը, որի ժամանակ իմացել է, որ Լազարը դանակով հարվածել է ընկերոջ հորը, և վերջինս տեղափոխվել է հիվանդանոց: Քրեական գործի դատաքննության փուլում, երբ Արթուր Կարապետյանը ցուցմունք է տվել, որ ինքը ոչնչից տեղյակ չէ, հրապարակվել է նրա նախաքննական ցուցմունքը, որի կապակցությամբ վերջինս հայտնել է, որ նախաքննական մարմնին նման բովանդակությամբ ցուցմունք չի տվել: Դատավորի առաջարկով գործով վկա Ա. Կարապետյանը ուսումնասիրել է նախաքննության ժամանակ իր հարցաքննության արձանագրությունը և պարզել, որ այն իր ձեռագրով գրված չէ, իսկ ստորագրությունը նմանեցված է: Այնուհետև Արթուր Կարապետյանը ոստիկանության բաժնում հաղորդում է տվել այն մասին, որ քրեական գործը քննող քննիչը կեղծել է իր նախաքննական ցուցմունքը, կազմել է հարցաքննության կեղծ արձանագրություն, կեղծել իր ստորագրությունը:
Դեպքի առթիվ ՀՀ հատուկ քննչական ծառայությունում ՀՀ քրեական օրենսգրքի 314-րդ հոդվածի 1-ին մասով հարուցված քրեական գործի նախաքննության ընթացքում նշանակված դատաձեռագրաբանական փորձաքննության արդյունքներով պարզվել է, որ վկայի հարցաքննության արձանագրությունում Ա. Կարապետյանի անունից կատարված ձեռագիր գրառումները, ինչպես նաև ստորագրությունները կատարվել են իր՝ Արթուր Կարապետյանի կողմից: Փորձաքննության եզրակացության շուրջ լրացուցիչ հարցաքննության ժամանակ Արթուր Կարապետյանը հայտնել է, որ ոստիկանության բաժնում կեղծիքի վերաբերյալ հաղորդում է տվել՝ մտածելով, որ այդ կերպ կարող է օգտակար լինել ընկերոջը: Սուտ մատնության կատարման մեջ մեղադրվող Ա. Կարապետյանը նախաքննության ընթացքում խոստովանել է, որ քրեական գործը քննող քննիչի մոտ ինքն անձամբ է գրել ու ստորագրել ցուցմունքները:
ՀՀ հատուկ քննչական ծառայությունում քննվող քրեական գործի նյութերով ՀՀ քրեական օրենսգրքի 333-րդ հոդվածի 1-ին մասով հարուցված նոր քրեական գործով Արտակ Կարապետյանին մեղադրանք էր առաջադրվել այն բանի համար, որ նա, նախազգուշացված լինելով ակնհայտ սուտ մատնություն կատարելու համար նախատեսված քրեական պատասխանատվության մասին, գիտակցելով, որ իր տրամադրած տեղեկատվությունը կեղծ է, կատարել է սուտ մատնություն, այն է՝ պաշտոնեական կեղծիք կատարելու մեջ մեղադրել է ՀՀ քննչական կոմիտեի Վայոց Ձորի քննչական վարչության ՀԿԳ ավագ քննիչին:
ՀՀ հատուկ քննչական ծառայությունում որոշում էր կայացվել ՀԿԳ ավագ քննիչի նկատմամբ քրեական հետապնդում չիրականացնել և վերջինիս կողմից պաշտոնեական կեղծիք կատարելու դեպքով հարուցված քրեական գործի վարույթը հանցագործության դեպքի բացակայության հիմքով կարճել:
Նախաքննությունն ավարտած քննիչը քրեական գործը մեղադրական եզրակացությամբ հանձնել է դատավարական հսկողություն իրականացնող դատախազին՝ այն հաստատելու և դատարան ուղարկելու համար:
