Ստեփանակերտում՝ ԼՂՀ վերաքննիչ դատարանում, փետրվարի 26-ին տեղի է ունեցել անցած տարվա հուլիսին Շահումյանի շրջանով ԼՂՀ պետական սահմանն ապօրինաբար հատած ադրբեջանական հետախուզական-դիվերսիոն խմբի երկու անդամների՝ Դիլհամ Ասկերովի և Շահբազ Գուլիևի գործով վերաքննիչ դատական նիստը, որը վարել են դատավորներ Հրայր Աբրահամյանը և Կարեն Սաֆարյանը՝ Նորայր Գրիգորյանի նախագահությամբ: «Արմենպրես»-ի հաղորդմամբ՝ ինչպես տեղեկացնում է «Արցախպրես»-ը, դատավոր Նորայր Աբրահամյանի կողմից նախ ընթերցվել են այն հոդվածները, ըստ որոնց մեղադրվում են Դիլհամ Ասկերովն ու Շահբազ Գուլիեւը, այնուհետև ամբաստանյալների փաստաբաններ Էրիկ Բեգլարյանը և Արկադի Իսրայելյանը ներկայացրել են բողոքարկման հետ կապված այն հիմնավորումը, ըստ որի, ԼՂՀ ընդհանուր իրավասության առաջին ատյանի դատարանի կայացրած որոշումը չի բավարարում իրենց պաշտպանյալներին։ Էրիկ Բեգլարյանը նշել է, որ առաջին ատյանի դատարանի վճիռը իր պաշտպանյալ Ասկերովի մասով ենթակա է մասնակի բեկանման, իսկ Արկադի Իսրայելյանը պնդել է, որ իր պաշտպանյալի մասով վճիռը պետք է ամբողջությամբ բեկանվի։
Իր հերթին պետական մեղադրող Կարեն Գաբրիելյանը ներկայացրել է դատավարությանը վերաբերող փաստարկները և փորձաքննությունների արդյունքները, այդ թվում՝ լրտեսության, սպանության, կատարած նկարահանումների, երեխայի առևանգման և զենք-զինամթերքի մասով։ Իսկ սպանված Սմբատ Ցականյանի իրավահաջորդ Մեխակ Ցականյանն իր ելույթում նշել է, որ համաձայն չէ ամբաստանյալների բողոքարկմանը, քանի որ, իր կարծիքով, առաջին ատյանի դատարանը արդարացի որոշում է կայացրել։
Նիստի ընթացքում ամբաստանյալներ Դիլհամ Ասկերովը և Շահբազ Գուլիևը, ներկայացնելով իրենց բողոքները, մասնավորապես, նշել են, որ համաձայն չեն ԼՂՀ ընդհանուր իրավասության առաջին ատյանի դատարանի կայացրած որոշման հետ, քանի որ նրանք ղարաբաղա-ադրբեջանական սահմանը հատելիս չեն գիտակցել, որ այն անում են ապօրինաբար, լրտեսություն չեն կատարել և սպանության մեջ իրենց մեղավոր չեն ճանաչում: «Ադրբեջանի հատուկ ծառայությունների հետ ես կապ չեմ ունեցել և չգիտեմ Հասան Հասանովը (հանցախմբի մյուս սպանված անդամը) արդյո՞ք եղել է Ադրբեջանի հատուկ ծառայությունների աշխատակից, թե ոչ»,- դատական նիստի ժամանակ ասել է Դիլհամ Ասկերովը՝ հավելելով, որ ինքը չի սպանել երեխային, այլ սպանել է Հասան Հասանովը: Իսկ իր կատարած տեսանկարահանումների՝ համացանցում հայտնվելու վերաբերյալ Ասկերովը դժվարացել է պատասխանել, թե ով կարող է արած լինել դա:
Իր հերթին ամբաստանյալ Գուլիևը շարունակել է պնդել, որ իրեն ոչ մի հոդվածով մեղավոր չի ճանաչում։
Դատարանը, լսելով կողմերին, հաջորդ դատական նիստը նշանակել է մարտի 10-ին՝ ժամը 11։00-ին:
Դիլհամ Ասկերովին մեղադրանք էր առաջադրվել Լեռնային Ղարաբաղի քրեական օրենսգրքի 7-րդ, իսկ նույն երկրի քաղաքացի Շահբազ Գուլիևին ՝ 5-րդ հոդվածների հատկանիշներով: Նրանք մեղադրվում են ազգային ատելության շարժառիթներով մարդուն առևանգելով սպանելու, կազմակերպված խմբի կողմից անչափահասի նկատմամբ զենքի գործադրմամբ բռնություն գործադրելու, լրտեսության, Ղարաբաղի պետական սահմանը կազմակերպված խմբի կողմից հատելու, հրազեն և ռազմամթերք կրելու մեջ։ Դիլհամ Ասկերովին նաև կազմակերպված խմբի կողմից ազգային ատելության շարժառիթով երկու անձանց սպանության փորձի մեղադրանք էր առաջադրվե լ։ ԼՂՀ ընդհանուր իրավասության առաջին ատյանի դատարանի վճռով Դիլհամ Ասկերովը դատապարտել է ցմահ, իսկ Գուլիևն էլ 22 տարվա ազատազրկման:
