Վարդան Պետրոսյանի գործով վերահսկող դատախազը բողոք է ներկայացրել Վերաքննիչ դատարան: «Վարդան Պետրոսյանի գործով վերահսկող դատախազ Արթուր Սարգսյանի բողոքի բովանդակությանը ծանոթ չեմ, սակայն, ամենայն հավանականությամբ, նա պահանջելու է վերանայել Վարդան Պետրոսյանի պատժաչափը, իսկ տուժող կողմի բողոքի մասին տեղեկություններ դեռևս չունեմ (Վերաքննիչ դատարան բողոք ներկայացնելու վերջնաժամկետը մարտի 2-ը ժամը 12:00-ն էր)»,- «Արմենպրես»-ի հետ զրույցում' նշեց Վարդան Պետրոսյանի փաստաբան Նիկոլայ Բաղդասարյանը:
Ավելի վաղ' Վարդան Պետրոսյանի փաստաբան Նիկոլայ Բաղդասարյանը հայտարարել էր, որ բողոք լինելու դեպքում գործը կքննվի արագ ընթացակարգով, իսկ բողոքի բացակայության դեպքում' մի քանի օրվա ընթացքում Վարդան Պետրոսյանը դուրս է գալու մեկուսարանից և պատիժը կրելու է բաց ռեժիմով:
2015 թվականի հունվարի 29-ին Կոտայքի մարզի ընդհանուր իրավասության դատարանը 2013թ. հոկտեմբերի 20-ին տեղի ունեցած ավտովթարի գործով մեղավոր ճանաչեց դերասան Վարդան Պետրոսյանին' նրան դատապարտելով 5 տարվա ազատազրկման' 2 տարով զրկելով տրանսպորտային միջոցներ վարելու իրավունքից։
Կոտայքի մարզի ընդհանուր իրավասության դատարանում հունվարի 16-ին տեղի ունեցած նիստին դատախազ Արթուր Սարգսյանը հանդես էր եկել մեղադրական ճառով և պահանջել Վարդան Պետրոսյանին դատապարտել 6 տարի 6 ամիս ազատազրկման:
Վարդան Պետրոսյանին ՀՀ քրեական օրենսգրքի 242 հոդվածի երրորդ մասի հատկանիշներով (ճանապարհային երթևեկության կամ տրանսպորտային միջոցների շահագործման կանոնները խախտելը, որն անզգուշությամբ առաջացրել է երկու կամ ավելի մարդու մահ) մեղադրանք էր առաջադրվել այն բանում, որ 2013թ. հոկտեմբերի 20-ին, ժամը 22:10-ի սահմաններում, Կոտայքի մարզի Սարալանջ գյուղի կողմից դեպի Երեւան վարելիս «ԲՄՎ-320» մակնիշի մեքենան և հասնելով Եղվ արդ-Երևան ավտոճանապարհի երկրորդ կմ հատվածին, իրականացրել է ոչ պատշաճ և վտանգավոր երթևեկություն' ավտոմեքենան վարել է բնակավայրում սահմանված թույլատրելի առավելագույնը գերազանցող առնվազն' 71 կմ/ժ արագությամբ և երթևեկության ընթացքում միաժամանակ օգտվելով հեռախոսակապից, ինքն իրեն զրկել է ավտոմեքենայի լիարժեք կառավարումն իրականացնելու տեխնիկական հնարավորությունից, թույլ է տվել ՃԵԿ-ի խախտում, որի արդյունքում ավտոմեքենան դուրս է բերել երթևեկելի մասից դեպի աջ և առջևի մասով ընդհարվել է հողածածկ կողնակում կանգնած վիճակում գտնվող «ՎԱԶ 21214» մակնիշի մեքենայի հետնամասին, ինչի հետևանքով «ՎԱԶ-21214» մակնիշի մեքենայի ուղևորներ Էդվարդ և Էդգար Հակոբյանները մահացել են, իսկ ուղեւորներ Տաթեւիկ Հակոբյանը, Հայկ Հակոբյանը, էմմա Հակոբյանը, ինչպես նաև վարորդ Արթուր Հակոբյանն ստացել են վնասվածքներ:
Դատավարության ընթացքում տուժող կողմը պնդում էր, որ Վարդան Պետրոսյանը վթարի պահին եղել է ալկոհոլի ազդեցության տակ և այդ պատճառով է գերազանցել է թույլատրելի արագությունը։ Վարդան Պետրոսյանը, հերքելով այդ վարկածը, փորձում էր ապացուցել, որ տուժող կողմի մեքենան կայանած է եղել ոչ թե ճանապարհի հողածածկ կողնակին, այլ երթևեկելի գոտում։
