ՀՀ հատուկ քննչական ծառայությունում քննվող քրեական գործի նախաքննությամբ պարզվել է, որ ՀՀ քննչական կոմիտեի զինվորական քննչական գլխավոր վարչության 2-րդ կայազորային քննչական բաժնի հատկապես կարևոր գործերի քննիչ Շահեն Հայրապետյանը աշխատանքի բերումով տեղեկացել է, որ նույն բաժնի քննիչն իր վարույթում քննվող քրեական գործով ՀՀ քրեական օրենսգրքի 359-րդ հոդվածի 1-ին մասով նախատեսված հանցագործության կատարման համար մեղադրանք է առաջադրել իր ծանոթ, պայմանագրային զինծառայող, ենթասպա Նարեկ Ավանեսյանին:

Քրեական գործը մեղադրական եզրակացությամբ դատարան ուղարկվելուց հետո Նարեկ Ավանեսյանը պաշտպան ունենալու հարցում իրեն աջակցելու համար դիմել է Շահեն Հայրապետյանի օգնությանը:

Վերջինս, խաբեության և վստահությունը չարաշահելու եղանակով ուրիշի գույքի խոշոր չափերով հաշտակություն կատարելու դիտավորությամբ, պաշտոնեական դիրքն օգտագործելով, օգտվելով Նարեկ Ավանեսյանի կողմից իր հանդեպ ձևավորված վստահությունից, նրան առաջարկելու, հորդորելու եղանակով դրդել է կատարած հանցագործության համար ազատազրկման ձևով պատիժ չկրելու կամ պատիժը պայմանականորեն չկիրառելու համար իր միջոցով խոշոր չափերի՝ 2 հազար ԱՄՆ դոլարի սահմաններում կաշառք տալ մեղադրանքը դատարանում պաշտպանող ՀՀ զինվորական դատախազության թիվ 2 կայազորի դատախազության դատախազին, ինչին Նարեկ Ավանեսյանը համաձայնել է:

Շահեն Հայրապետյանը, իրագործելով իր հանցավոր դիտավորությունը, ի սկզբանե նպատակ չունենալով կաշառքի առարկան փոխանցել դատախազին կամ այլ պաշտոնատար անձի, 2014թ. հոկտեմբերի 7-ին իր աշխատասենյակում Նարեկ Ավանեսյանից ստացել է խոշոր չափերի՝ 800.000 ՀՀ դրամ գումար և խարդախությամբ հափշտակել այն, միաժամանակ, կաշառք տալու փորձի դրդչություն կատարելով Նարեկ Ավանեսյանի նկատմամբ:

Շահեն Հայրապետյանին Հատուկ քննչական ծառայությունում մեղադրանք է առաջադրվել ՀՀ քրեական օրենսգրքի 178-րդ հոդվածի 2-րդ մասի 1.1-րդ, 2-րդ կետերով և 38-34-312-րդ հոդվածի 2-րդ մասով, իսկ Նարեկ Ավանեսյանին' ՀՀ քրեական օրենսգրքի 34-312-րդ հոդվածի 2-րդ մասով:

Մինչդատական վարույթում Շահեն Հայրապետյանի նկատմամբ որպես խափանման միջոց ընտրվել է կալանավորումը: ՀՀ հատուկ քննչական ծառայությունում քրեական գործի նախաքննությունն ավարտվել է և գործը մեղադրական եզրակացությամբ հանձնվել է դատավարական հսկողություն իրականացնող դատախազին՝ այն հաստատելու և դատարան ուղարկելու համար:
