Արդարադատության նախարար Ռուստամ Բադասյանն այսօր՝ նոյեմբերի 1-ին, մասնակցել է ՀՀ քրեակատարողական նոր օրենսգրքի նախագծին նվիրված երկօրյա քննարկումների շարքի առաջին հանդիպմանը, որը կազմակերպել էր Միջազգային իրավական համագործակցության գերմանական հիմնադրամը: Այս մասին հայտնում են ՀՀ ԱՆ տեղեկատվության և հասարակայնության հետ կապերի վարչությունից։

Նախարարն իր շնորհակալական խոսքն է ուղղել Գերմանիայի Դաշնային Հանրապետությանը և հատկապես Միջազգային իրավական համագործակցության գերմանական հիմնադրամին՝ Արդարադատության նախարարության հետ արդյունավետ համագործակցություն ծավալելու և հանդիպումը կազմակերպելու համար։

Նախարարը նաև նշել է, որ ներկայում քրեակատարողական և պրոբացիայի ոլորտում բարեփոխումների իրականացումը հանդիսանում է Կառավարության առաջնահերթություններից մեկը։ Ըստ այդմ՝ ներկայում լրամշակման փուլում է գտնվում Քրեակատարողական և պրոբացիայի ոլորտի 2019-2023 թվականների ռազմավարության նախագիծը։ Առաջիկայում այն կներկայացվի Կառավարության հաստատմանը։

Բարեփոխումների այս փուլում նախարար Բադասյանը կարևորել է Քրեակատարողական նոր օրենսգրքի ընդունումը, որը համահունչ կլինի միջազգային չափանիշներին, և դրա ուղղությամբ օրենսգրքի մշակմամբ զբաղվող աշխատանքային խմբի արդյունավետ աշխատանքը։

Նախարարը, բարձր գնահատելով Քրեակատարողական գործող օրենսգրքի դերը մեր երկրի իրավական համակարգում, միաժամանակ փաստել է, որ ժամանակակից պայմաններում այն օբյեկտիվորեն այլևս ի վիճակի չէ բավարար չափով իրացնել իրավական պետության ժողովրդավարական նվաճումները: Օրենսգրքում փոփոխությունների անհրաժեշտությունն առավել առարկայական են դարձել Հայաստանի Հանրապետության մասնակցությամբ միջազգային այնպիսի կազմակերպությունների գնահատականների լույսի ներքո, ինչպիսին են ԽԿԿ-ն, ՄԱԿ-ի Մարդու իրավունքների կոմիտեն և այլ կազմակերպությունները:

Ռուստամ Բադասյանը նշել է, որ Քրեակատարողական նոր օրենսգրքի նախագիծն իր մեջ պարունակում է շատ խնդիրների լուծմանն ուղղված առանցքային և նոր լուծումներ՝ միաժամանակ փաստելով, որ այդպիսի լուծումների նախանշման հարցում մեծ է Գերմանիայի Ստորին Սաքսոնիա երկրամասի Արդարադատության նախարարության պետքարտուղար դոկտոր Ստեֆան ֆոն դեր Բեքի ներդրումը։

Ամփոփելով իր խոսքը՝ նախարարն արդյունավետ քննարկում է մաղթել քննարկման մասնակիցներին։

Քննարկման մասնակիցներին իր ողջույնի խոսքն է ուղղել նաև ՀՀ-ում Գերմանիայի Դաշնային Հանրապետության դեսպան Միխայել Բանցհաֆը։ Դեսպանը կարևորել է Արդարադատության նախարարության հետ երկարատև և արդյունավետ համագործակցությունը և փաստել, որ այսպիսի հանդիպումները հիմք են հայ-գերմանական համագործակցության ակտիվացման համար։ Դեսպանի խոսքով՝ Քրեակատարողական նոր օրենսգրքի ընդունումը կնպաստի Հայաստանի Հանրապետության՝ որպես իրավական պետության կայացմանը:

Ողջույնի խոսքով են հանդես եկել նաև Միջազգային իրավական համագործացության գերմանական հիմնադրամի Հարավային Կովկասի և Հարավարևելյան Եվրոպայի բաժնի ղեկավար Ֆրանկ Հուփֆելդը, ԵՊՀ իրավագիտության ֆակուլտետի դեկան Գագիկ Ղազինյանը և Գերմանիայի Ստորին Սաքսոնիա երկրամասի արդարադատության նախարարույան պետքարտուղար Ստեֆան ֆոն դեր Բեքը։

Հանդիպման ընթացքում մասնակիցները քննարկել են պատժի նպատակներին, պատժի կատարման սկզբունքներին, դատապարտյալների վերասոցիալականացմանը և դրա հիմնական միջոցներին, պատժի կատարման նկատմամբ դատական վերահսկողությանը, կարճաժամկետ ազատազրկմանը և պատժի կրման պայմաններին առնչվող մի շարք հարցեր։
