Ազգային ժողովը քննարկում է «Վարչական իրավախախտումների վերաբերյալ» ՀՀ օրենքում փոփոխություններ և լրացումներ կատարելու մասին օրենքի նախագիծը, որով առաջարկվում է կարգավորել վարչական իրավախախտումների վերաբերյալ գործերով կայացված որոշումների հանձնման ընթացակարգերը:
Օրինագծի հեղինակ, հիմնական զեկուցող Արփինե Հովհաննիսյանը, ներկայացնելով նախագիծը, ընդգծեց, որ ներկայում ս օրենքով սահմանվում է, որ վարչական իրավախախտումների վերաբերյալ որոշումները համարվում են ստացված, եթե նույնիսկ խախտում կատարած տրանսպորտային միջոցի վարորդը ծանուցումն ուղարկելու պահին չի գտնվել իր կողմից նշված հաշվառման վայրում, ինչը խնդիրներ է առաջացնում քաղաքացիների համար:
«Նշված իրավակարգավորումը գործնականում առաջացնում է մի շարք դժվարություններ քաղաքացիների համար, քանի որ, շատ հաճախ իրազեկված չլինելով կայացված որոշումների մասին, նրանք ոչ միայն հնարավորություն չեն ստանում գանգատարկելու կամ բողոքարկելու կայացված որոշում, այլ նաեւ ավելանում է որոշմամբ սահմանված տուգանքի չափը:
Այդիսկ պատճառով նախագծով առաջարկվում են հստակ ընթացակարգեր, որոնք հնարավորություն են տալիս քաղաքացիներին լինել իրազեկված իրենց վերաբերյալ կայացված որոշումների մասին»,- «Արմենպրես»-ի հաղորդմամբ՝ ասաց Հովհաննիսյանը:
Մանրամասնելով՝ պատգամավորը նշեց, որ նախագծով առաջարկվում է սահմանել, որ վարչական իրավախախտումների վերաբերյալ որոշման մասին ծանուցումը պետք է ուղարկվի անձամբ հասցեատիրոջը և այն կարելի է համարել հանձնված միայն այն դեպքում, երբ դրա տակ առկա է հասցեատիրոջ ստորագրությունը:
«Բացի այդ, նախագծով կարգավորված են նաեւ այն դեպքերը, երբ որոշման հասցեատերը ճիշտ չի նշել իր հասցեն կամ նրա հայտնած հասցեով ուղարկված որոշումը վերադարձվել է կամ հասցեատերը հրաժարվել է ստանալ ուղարկված որոշումը: Նշված դեպքերում որոշումը ուղարկվում է այդ անձի հաշվառման հասցեով եւ տեղադրվում է Հայստանի Հանրապետության հրապարակային ծանուցումների պաշտոնական ինտերնետային կայքում:
Միեւնույն ժամանակ ցանկանում եմ նշել, որ նախագիծը մշակելիս համագործակցել ենք կառավարության հետ, եւ նախագիծը ներկայացվում է կառավարության հետ»,- ընդգծեց Հովհաննիսյանը:
