Վարչական իրավախախտումների մասին օրենքի նախագիծը չի կարգավորում վարորդներին տուգանքների մասին պատշաճ ծանուցելու խնդիրը։ Այս տեսակետը լրագրողների հետ հանդիպմանը ներկայացրեց «Աքիլես» ավտովարորդների իրավունքների պաշտպանության կենտրոն» հասարակական կազմակերպության նախագահ Էդուարդ Հովհաննիսյանը։
Բանախոսը նկատեց, որ օրենքի նախագիծը կարդալուց հետո նրա մոտ առաջացել են որոշակի հարցեր։ «Ինչպե՞ս պետք է ստուգել անձի իսկությունը, քանի որ, ըստ նախագծի, փոստատարը կարող է ծանուցումը տալ այն անձին, ով կներկայա որևէ մարդու անունով՝ առանց անձը հաստատող փաստաթղթի»:
«Արմենպրես»-ի հաղորդմամբ՝ հասարակական կազմակերպության իրավաբան Արմինե Մկրտչյանը նշեց, որ այս օրինագծով խախտվում է «Փաստաթղթերի հատուկ առաքման» մասին օրենքը։ «Ըստ օրենքի՝ փոստատարը պետք է անձը հաստատող փաստաթղթով ստուգի քաղաքացու իսկությունը, որից հետո միայն հանձնի ծանուցագիրը։ Այժմ, ծանուցագրում ստորագրությունից և ամիս- ամսաթիվը նշելուց բացի, չի նշվում քաղաքացու անուն-ազգանունը, որը օրենքի խախտում է»,- պարզաբանեց իրավաբանը։
Հովհաննիսյանի կարծիքով էլ՝ այս ամենը հանգեցնում է նրան, որ Ճանապարհային ոստիկանությունը շատ հաճախ ստանում է ծանուցագրեր, որում հասցեատերերի փոխարեն ստորագրած են լինում կողմնակի անձիք, իսկ քաղաքացիները, տեղյակ չլինելով տուգանքների մասին, հետագայում դատարանից ստանում են տուգանքի եռապատկման կամ հնգապատկման որոշումներ։
Բանախոսն ընդգծեց, որ նույնիսկ վերը նշված խնդիրը լուծելով՝ դեռ շատ խնդիրներ մնում են չլուծված։ «Կան բազմաթիվ քաղաքացիներ, ովքեր սահմանված ժամկետում մուծում են տուգանքները, սակայն նույնպես ստանում են տուգանքի եռապատկման կամ հնգապատկման մասին դատական որոշումներ։ Պատճառն այն է, որ տուգանքների վճարումների մասին տեղեկությունը ինչ-ինչ պատճառներով ժամանակին չի հասնում Ճանապարհային ոստիկանություն, իսկ վերջինս, առանց ստուգելու, թե տվյալ քաղաքացին օրենքով սահմանված ժամկետում վճարել է տուգանքը, թե ոչ, գործն ուղ արկում է դատարան։ «Ստացվում է, որ շատերը տուգանքը մուծելուց հետո պետք է անձամբ այդ մասին հայտնեն Ճանապարհային ոստիկանությանը, որպեսզի հետագայում խուսափեն դատական քաշքշուքներից, ինչն անընդունելի է»,- հավելեց Հովհաննիսյանը։
Ազգային Ժողովը 2014թ. սեպտեմբերի 10-ին, ձայների 112 կողմ և 6 ձեռնպահ հարաբերակցությամբ առաջին ընթերցմամբ ընդունեցին Արփինե Հովհաննիսյանի հեղինակած' վարչական իրավախախտումների մասին օրենքի նախագիծը: Նախագծով սահմանվում են վարչական իրավախախտումների վերաբերյալ կայացված որոշումների մասին ծանուցման ընթացակարգերը: Մասնավորապես, սահմանվում է, որ քաղաքացին իր վերաբերյալ կայացված որոշմանը պատշաճ ծանուցված կհամարվի, եթե նա անձամբ կստանա ծանուցագիրը եւ առկա կլինի ստանալու մասին նրա ստորագրությունը: «Վարչական իրավ ախախտումների մասին» Հայաստանի Հանրապետության օրենսգրքում փոփոխությունների համաձայն' 283 հոդվածի 6-րդ պարբերությունում գրված է, որ որոշումը համարվում է անձամբ հանձնված, եթե դրա ստացման մասին անդորրագիրը ստորագրված է անձամբ հասցեատիրոջ կողմից, կամ հասցեատերը որոշումը ստանալու անդորրագրի վրա ստորագրել է որոշումը ստանալուց հրաժարվելու մասին։
