Շիրակի մարզի դատարանը կայացրել է սոցիալական ոլորտում չարաշահումների վերաբերյալ հերթական գործով դատավճիռը՝ 4 ամբաստանյալի վերաբերյալ, որով հաստատված է համարել առավել քան 80 մլն դրամի հափշտակության փաստը:

Դատարանը ՀՀ աշխատանքի և սոցիալական հարցերի նախարարության սոցիալական ապահովության պետական ծառայության Գյումրու տարածքային բաժնի արդեն նախկին պետ Էդուարդ Վարժապետյանին հանցավոր է ճանաչել՝ ՀՀ քրեական օրենսգրքի 179-րդ հոդվածի 3-րդ մասի 1-ին կետով՝ առանձնապես խոշոր չափերով յուրացնելը կամ վատնելը, և դատապարտել ազատազրկման՝ 4 տարի ժամկետով՝ առանց գույքի բռնագրավման:

Միաժամանակ նրա նկատմամբ կիրառվել է ՀՀ Ազգային Ժողովի՝ 03.10.2013 թվականի «ՀՀ անկախության հռչակման 22-րդ տարեդարձի կապակցությամբ համաներում հայտարարելու մասին» որոշումը, և նա ազատվել է նշանակված պատժի կրումից:

ՀՀ աշխատանքի և սոցիալական հարցերի նախարարության սոցիալական ապահովության պետական ծառայության Գյումրու տարածքային բաժնի նախկին գլխավոր մասնագետ Արթուր Աբրահամյանը հանցավոր է ճանաչվել՝ ՀՀ քրեական օրենսգրքի 179-րդ հոդվածի 3-րդ մասի 1-ին կետով և դատապարտվել ազատազրկման՝ 4 տարի ժամկետով՝ առանց գույքի բռնագրավման:

ՀՀ աշխատանքի և սոցիալական հարցերի նախարարության սոցիալական ապահովության պետական ծառայության վճարումների ծառայության Գյումրու տարածքային ստորաբաժանման նախկին տեսուչ-վճարող Կիմա Փիլոյանը հանցավոր է ճանաչվել՝ ՀՀ քրեական օրենսգրքի 325-րդ հոդվածի 1-ին մասով՝ փաստաթղթեր կեղծելը, և դատապարտվել ազատազրկման՝ 1 տարի ժամկետով: Սակայն ՀՀ Ազգային Ժողովի՝ 26.05.2011 թվականի «ՀՀ անկախության հռչակման 20-րդ տարեդարձի կապակցությամբ համաներում հայտարարելու մասին» որոշման կիրառմամբ ազատվել է այդ մեղադրանքի մասով նշանակված պատժի կրումից:

Կիմա Փիլոյանը հանցավոր է ճանաչվել՝ ՀՀ քրեական օրենսգրքի 179-րդ հոդվածի 3-րդ մասի 1-ին կետով և դատապարտվել ազատազրկման՝ 4 տարի ժամկետով՝ առանց գույքի բռնագրավման:

ՀՀ աշխատանքի և սոցիալական հարցերի նախարարության սոցիալական ապահովության պետական ծառայության վճարումների ծառայության Գյումրու տարածքային ստորաբաժանման նախկին պատասխանատու Ռուբեն Մնացականյանը հանցավոր է ճանաչվել ՀՀ քրեական օրենսգրքի 308-րդ հոդվածի 2-րդ մասով՝ պաշտոնեական լիազորությունները չարաշահելը, որն անզգուշությամբ առաջացրել է ծանր հետևանքներ, և դատապարտվել ազատազրկման 3 տարի ժամկետով: Նա միաժամանակ զրկվել է ֆինանսատնտեսական գործունեությամբ զբաղվելու իրավունքից՝ 2 տարի ժամկետով:

Դատավճռով մասնակի բավարարվել է ՀՀ Գլխավոր դատախազության քաղաքացիական հայցը և Արթուր Աբրահամյանից, Կիմա Փիլոյանից ու Ռուբեն Մնացականյանից համապարտության կարգով հօգուտ ՀՀ պետբյուջեի պետք է բռնագանձվի 54.608.394 ՀՀ դրամ:

Էդ.Վարժապետյանի կողմից որպես հանցագործությամբ պատճառված վնասի հատուցում ՀՀ Գլխավոր դատախազության դեպոզիտ հաշվին վճարված 3.000.000 և ՀՀ Շիրակի մարզի ընդհանուր իրավասության դատարանի դեպոզիտ հաշվին վճարված 1.338.000 ՀՀ դրամ վճարված գումարները դատավճիռն օրինական ուժի մեջ մտնելուց հետո պետք է փոխանցվի ՀՀ պետական բյուջեի համապատասխան հաշվեհամարին:

Այսպիսով, դատարանն ապացուցված է համարել, որ Արթուր Աբրահամյանը, պետությունից յուրացման եղանակով առանձնապես խոշոր չափերի հասնող գումարների հափշտակություն կատարելու վերաբերյալ նախնական համաձայնության գալով նույն տարածքային բաժնի պետ Էդուարդ Վարժապետյանի հետ, յուրացման եղանակով հափշտակել են իրենց վստահված 9 կենսաթոշակառուների անվամբ անհիմն ելքագրված առանձնապես խոշոր չափերի՝ ընդհանուր 4.337.835 ՀՀ դրամ կենսաթոշակի գումարները:
