«Կատարողական վարույթի խնդիրների ավանդական եւ նորարարական լուծումները» թեմայով գիտագործնական համաժողովի շրջանակներում Հայաստանի գլխավոր հարկադիր կատարող արդարադատության գեներալ-մայոր Միհրան Պողոսյանը ճեպազրույց է ունեցել լրագրողների հետ, պատասխանել նրանց հարցերին:
Միհրան Պողոսյանն ընդգծել է, որ Հայաստանի Հանրապետության հարկադիր կատարման ծառայությունն արդեն երկրորդ անգամ կազմակերպում է միջազգային գիտագործնական համաժողով: Առաջինը նվիրված է եղել մասնավոր եւ պետական հատվածների համակցությանը եւ որոշակի աշխատանքներ ծավալելուց հետո հարկադիր կատարման ծառայությունն ընտրել է այն ուղղվածություն, ինչ որ ունի այսօր: «Այսօրվա միջազգային գիտաժողովի թեման դա հարկադրանքի կիրառման այսպես ասած սահմաններն են: Ինչպես տեսնում եք, տարբեր պետություններում տարբեր մեթոդներ են օգտագործում: Մեզ համար հարկավոր է հասկանալ, թե ինչ չափով եւ ինչ ոլորտներում հարկադրանքը պետք է կիրառել, հասկանալ մի բան, որ մի կողմից այդ հարկադրանքը պահանջատիրոջ իրավունքների պահանջներին է ուղղված, այսինքն մենք պահանջատիրոջ կողմից ապահովում ենք դատավճռի կատարումը, սակայն մյուս կողմից պետք է հասկանալ, որ գոյություն ունի մարդու իրավունքների անվտանգություն, եւ մենք պետք է կարողանանք հարկադրանքի կիրառմամբ մարդու իրավունքների խափանման դաշտ չներխուժել»,- ասել է Մ. Պողոսյանը:
Նա ընդգծել է, որ սա է հիմնականում անցկացվելիք գիտաժողովի առանցքը: Հայաստանի գլխավոր հարկադիր կատարողը մեծ հաջողություն է համարում այն հանգամանքը, որ ավելի քան 15 երկիր առաջին դեմքով է ներկայացված համաժողովում, ինչը խոսում է թեմայի կարեւորության մասին:
Մ. Պողոսյանը նկատել է, որ ամեն մի գիտաժողովից հետո նոր լուծումներ եւ նոր նախաձեռնություններ են լինում՝ չբացառելով, որ միգուցե ինչ-որ նոր առաջարկներ եւ նորամուծություններ կլինեն նաեւ այս անգամ անցկացվելիք համաժողովի արդյունքում:
Անդրադառնալով հարկադիր կատարման ոլորտում առկա խնդիրներին՝ Հայաստանի գլխավոր հարկադիր կատարողը նշել է, որ դրանք բազմազան են: Նա տեղեկացրել է,, որ այսօր ծառայությունում 60 անգամ ավելացել է աշխատանքը: Եթե 6-7 տարի առաջ ամսական ստացել են 2000 վարույթ, ապա այս պահին ստանում են ամսեկան 120 հազար վարույթ: «Հարկադիր կատարման ծառայությունը մեկ ամսում 120 հազար վարույթ է իրականացնում. սա աննախադեպ քանակ է: Ցանկանում եմ շեշտադրել մի կարեւոր փաստ, որ աշխատակիցների քանակը չի ավելացել եւ պետական բյուջեի վրա ծախսային հոդված չենք ավելացրել: Այս ամենը պայմանավորված է տեղեկատվական տեխնոլոգիաների ներդրումով: Այս գիտաժողովը նվիրված է հենց դրան եւ մենք պետք է հասկանանք, որոնք են հարկադրանքի սահմանները եւ ինչքան կարող ենք օգտագործել հարկադրանքի սահմանը: Պետք նաեւ ասեմ, որ մեր ոլորտում մարդու իրավունքների ոտնահարում չունենք: Դա պայմանավորված է վարչական իրավախախտումների մասին օրենքի փոփոխություններով, ինչպես նաեւ ծառայության վարկանիշի բարձրացման շնորհիվ, ինչը մեզ համար մեծ պատիվ է»,- ասել է նա:
Անդրադառնալով ոլորտում առկա խնդիրների լուծման համար այլ գերատեսչությունների հետ համագործակցությանը՝ Միհրան Պողոսյանն ընդգծել է, որ իրենք համագործակցում են Հայաստանի բոլոր բանկերի, ճանապարհային ոստիկանության հետ: Նա նշել է, որ նախկինում եղել են դեպքեր, երբ բանկերն ավելի շատ են դրել կալանքի չափը, քան ուղարկել է Հայաստանի հարկադիր կատարման ծառայությունը, սակայն այդ խնդիրներն արդեն կարգավորված են:
