«Ժամանակավոր անաշխատունակության նպաստների մասին» ՀՀ օրենքի նախագիծը կարգավորում է ժամանակավոր անաշխատունակության նպաստների տրամադրման հետ կապված հարաբերությունները, սահմանում է ժամանակավոր անաշխատունակության նպաստի հասկացությունը, տեսակները, դրա հաշվարկման, նշանակման և վճարման պայմաններն ու կարգը: Այս մասին Ազգային ժողովում «Ժամանակավոր անաշխատունակության մասին նպաստների մասին ՀՀ օրենքում փոփոխություններ և լրացումներ կատարելու մասին» օրենքի նախագծի քննարկման ժամանակ հայտարարեց ՀՀ աշխատանքի և սոցիալական հարցերի նախարար Արտեմ Ասատրյանը: «Գործող իրավակարգավորումների արդյունքում էապես նվազում է ժամանակավոր անաշխատունակության նպաստների ուղղությամբ կատարվող ծախսերի հասցեականությունը: Մասնավորապես, կորցրած եկամուտը երբեմն փոխհատուցվում է ավելիով, քան աշխատողի աշխատավարձն է, որը նա կստանար, եթե ժամանակավոր անաշխատունակության ժամանակահատվածում աշխատեր: Խնդրո առարկա է նաև այն հանգամանքը, որ անձին, որպես վարձու աշխատող գրանցելու և նրան մեկ-երկու ամիս ամիս հետո նպաստ վճարելու համար որևէ օրենսդրական արգելք չկա, ինչից ակնհայտորեն օգտվում են գործատուները, իսկ նպաստը հաշվարկելու համար հիմք ընդունվող միջին ամս ական աշխատավարձի հաշվարկման կարգը և առավելագույն շեմի բացակայությունն առանձին դեպքերում ետին պլան են մղում նպաստի սոցիալական էությունը»,- «Արմենպրես»-ի հաղորդմամբ՝ նշեց նախարարը:
Նախարարը նկատեց, որ այս պարագայում ֆորմալ իմաստով օրենքը չի խախտվում: Միաժամանակ ՀՀ գործող օրենսդրությամբ չաշխատող մայրերի համար հղիության և ծննդաբերության ժամանակահատվածի համար որևէ դրամական վճար սահմանված չէ: Այսինքն՝ պետությունը չաշխատող կնոջը հղիության ընթացքում ուղղակի ֆինանսական աջակցություն չի ցուցաբերում:
Հաշվի առնելով ժամանակավոր անաշխատունակության նպաստների ոլորտում առկա խնդիրները և հղիության ու ծննդաբերության ժամանակահատվածի համար չաշխատող մայրերին սոցիալական աջակցություն տրամադրելու անհրաժեշտությունը՝ կառավարության ներկայացրած նախագծով առաջարկվում է հղիության և ծննդաբերության նպաստը վերանվանել մայրության նպաստի, պահպանել մայրության նպաստի չափը և միջին ամսական աշխատավարձը հաշվարկելու կարգը՝ սահմանելով մայրության նպաստի չափը հաշվարկելու համար հիմք ընդունվող միջին ամսական աշխատավարձի առավելագույն շեմ՝ նվազագույն ամսական աշխատավարձի 15-ապատիկի չափով: «Սա կկազմի շուրջ 1 մլն դրամ՝ 2015 թվականին և շուրջ 1.2 մլն դրամ՝ 2016 թվականին»,- նշեց Ասատրյանը:
Նախարարը տեղեկացրեց, որ առաջարկվում է սահմանել, որ Ժամանակավոր անաշխատունակության նպաստը հաշվարկվում է միջին ամսական աշխատավարձի 80%-ից: Ընդ որում՝ սահմանվում է նաև ժամանակավոր անաշխատունակության նպաստի չափը հաշվարկելու համար հիմք ընդունվող միջին ամսական աշխատավարձի առավելագույն շեմ՝ նվազագույն ամսական աշխատավարձի 10-ապատիկի չափով և պահպանվում է միջին ամսական աշխատավարձը հաշվարկելու կարգը:
Նախագծով առաջարկվում է նաև ՀՀ օրենքով սահմանել, որ հղիության և ծննդաբերության արձակուրդի ժամանակահատվածի համար մայրության նպաստ է նշանակվում նաև չաշխատող կնոջը:
Արտեմ Ասատրյանը վստահեցրեց, որ ներկայացվող նախագիծն ընդունվելու դեպքում էապես կբարելավվի սոցիալական պաշտպանության ոլորտում իրականացվող քաղաքականությունը՝ սկսած 2016 թվականից, հղիության և ծննդաբերության ժամանակահատվածի համար լրացուցիչ սոցիալական աջակցություն տրամադրելով շուրջ 30 000 չաշխատող կանանց, ինչը կարող է դրական ազդել ծնելիության ցուցանիշի վրա:
Միաժամանակ, բժշկական հաշվառման կանգնելը կարևոր խթան կհանդիսանա առողջ սերունդ ունենալու համար:
Առաջարկվող մեխանիզմի դեպքում, պահպանելով աշխատավարձի 100-տոկոսանոց փոխհատուցումը աշխատող կանանց մոտ, կներդրվեն տնտեսական խթաններ հնարավոր չարաշահումները կանխարգելելու համար:
