Կենտրոն և Նորք-Մարաշ վարչական շրջանների ընդհանուր իրավասության դատարանում Գագիկ Պողոսյանի նախագահությամբ շարունակվեց Արսեն Սիմոնյանի գործի դատական քննությունը:
Ըստ մեղադրական եզրակացության՝ նախկինում մի քանի անգամ դատապարտված, 30-ամյա Արսեն Սիմոնյանը հերթական պատիժը կալանավայրում կրելու ժամանակ «Օդնոկլասնիկի» սոցիալական կայքի միջոցով ծանոթացել է Սեդայի (անունը փոխված է) հետ, թաքցրել իր ամուսնացած լինելու հանգամանքը, խաբեության ու վստահությունը չարաշահելու եղանակով մաս-մաս աղջկանից հափշտակել է 6 միլիոն 700 հազար դրամ կանխիկ գումար:
Արսեն Սիմոնյանին մեղադրանք է առաջադրված խարդախության համար՝ ՀՀ քրեական օրենսգրքի 178 հոդվածի 3-րդ մասի 1-ին կետով:
Դատարանում Արսեն Սիմոնյանը ներկայացրեց իր անձը:
Նա Արմավիրի մարզի բնակիչ է, խոսում է՝ իր խոսքին փորձելով ինչ-որ երևութական ծանրակշռություն տալ: Ըստ երևույթին՝ այդպես է խոսել նաև «Օդնոկլասնիկի» կայքով և այլ եղանակներով ծանոթացած աղջիկների հետ, տպավորություն է գործել: Սակայն նախագահողի վրա ամբաստանյալի խոսքը նրա ցանկացած տպավորությունը չգործեց, և ի պատասխան նախագահողի դիտողության՝ ամբաստանյալն ասաց. «Իմ մոտ ամեն ինչ մի քիչ բարդ ա»:
Որոշ «բարդություն» կար՝ կարելի է համաձայնել:
Մեղադրական եզրակացության մեջ նշված է, թե ամբաստանյալը նախկինում 6 անգամ է դատվել, իսկ ամբաստանյալը սկզբում ասաց՝ 2 անգամ. «Իմ հիշողության մեջ այդքանն է, նկատի ունեմ՝ դրսից՝ ներսը, բայց եղել է նաև ներսից՝ ներս, մի անգամ ՝ ներսից՝ ներս»: «Դրսից՝ ներսը» ամբաստանյալի լեզվով նշանակում է՝ ազատության մեջ հանցանք գործել ու կալանավայր ընկնել, իսկ «ներսից՝ ներսը» նշանակում է կալանավայրի ներսում հանցանք գործել ու կալանավայրում շարունակել պատիժ կրել:
Այս ամենը նկատի առնելով՝ ամբաստանյալն ասաց, թե նախկինում 3 անգամ է դատվել, ապա հնչեց 4 անգամ դատվելու տարբերակը:
