ԱԺ պատգամավոր Արամ Մանուկյանի նկատմամբ կիրառված բռնարարքի դեպքի առթիվ Երեւանի քննչական վարչության վարույթում քննվող քրեական գործի շրջանակներում քաղաքացի Ա.Սվազյանը դեկտեմբերի 14-ին ներգրավվել է որպես կասկածյալ։
Հաշվի առնելով քրեական գործի նկատմամբ հասարակական մեծ հնչեղությունը՝ տեղեկացնում ենք, որ Ա.Մանուկյանի նկատմամբ նշանակված դատաբժշկական փորձաքննության թիվ 2185/հ եզրակացությամբ լիարժեք գնահատական չի տրվել նրան պատճառված մարմնական վնասվածքների աստիճանին։ Ըստ եզրակացության՝ գլխուղեղի ցնցման ելքի ոչ պարզ լինելու հետ կապված առողջությանը պատճառած վնասի աստիճանը կորոշվի դեպքի օրվանից երեք շաբաթ հետո` 31.12.2014 թվականին, որի համար անհրաժեշտ է ապահովել փորձաքննվողի ներկայությունը ԴԲԳԳԿ ամբուլատոր քարտով:
Ա.Մանուկյանի ստացած մարմնական վնասվածքի ծանրության աստիճանը պարզելու համար բացատրություն է վերցվել դատաբժշկական փորձաքննությունն իրականացրած փորձագետից, ով հայտնել է, որ փորձաքննության պահին Ա.Մանուկյանի մարմնական վնասվածքների ծանրության աստիճանը տատանվել է թեթև և միջին ծանրության մարմնական վնասվածքների սահմաններում: Մարմնական վնասվածքների ծանրության աստիճանը կորոշվի դեպքի օրվանից 21 օր հետո։
Պարզաբանում ենք, որ ՀՀ քրեական դատավարության օրենսգրքի 18-րդ հոդվածի 4-րդ մասը սահմանում է՝ «Մեղադրանքն ապացուցված լինելու վերաբերյալ բոլոր կասկածները, որոնք չեն կարող փարատվել սույն օրենսգրքի դրույթներին համապատասխան պատշաճ իրավական ընթացակարգի շրջանակներում, մեկնաբանվում են հօգուտ մեղադրյալի կամ կասկածյալի»։ Հետեւապես՝ անձը որպես կասկածյալ է ներգրավվել ՀՀ քրեական օրենսգրքի 117-րդ հոդվածով նախատեսված արարք կատարելու, այն է՝ Ա.Մանուկյանի առողջությանը թեթեւ վնասվածք պատճառելու համար, եւ նրա նկատմամբ որպես խափանման միջոց է ընտրվել ստորագրություն չհեռանալու մասին։Երեւանի քննչական վարչությունում նախաքննությունը շարունակվում է, միջոցներ են ձեռնարկվում՝ քրեական գործի հանգամանքների բազմակողմանի, լրիվ և օբյեկտիվ հետազոտման համար։ Դատաբժշկական փորձաքննության վերջնական եզրակացությունն ստանալուց հետո, քրեական գործով ձեռք բերված բավարար ապացույցների համակցությամբ Ա.Սվազյանի գործողություններին կտրվի համապատասխան քրեաիրավական գնահատական։
