«Դատաքննության ընթացքում անձը գտնվելու է ՀՀ տարածքում և հետագայում էլ քրեական պատասխանատվության և պատժի է ենթարկվելու Հայաստանում»,-Գյումրիում լրագրողների հետ հանդիպման ժամանակ հայտարարեց ՀՀ գլխավոր դատախազ Գևորգ Կոստանյանը:
Հարցին, թե Վալերի Պերմյակովը ռուսական ռազմաբազայի տարածքո՞ւմ է մնալու, թե՞ ոչ, Կոստանյանն ասաց.
«Նախաքննության և դատքաննության ընթացքում այդ անձը գտնվելու և քրեական պատասխանտվության է ենթարկվելու ՀՀ տարածքում, կգտնվի ռուսական ռազմաբազայի տարածքում, թե այլ տարածքում, դա կարևոր չէ: Կարևորը ՀՀ արդարադատության առաջ կանգնելու փաստն է: Սա է ամենակարևոր հարցը: Ես կարծում եմ, որ հենց այս հարցն է, որ պետք է քննարկման առարկա դարձնենք»:
ՀՀ գլխավոր դատախազը հայտնեց, որ պատժի կրման գործընթացը՝ առանձին գործընթաց է և դա քննարկվի միջազգային պայմանագրի համաձայն: Այս պահին դրա մասին խոսելը դեռևս վաղ է:
Գևորգ Կոստանյանն ընդգծեց, որ Գյումրիում կատարված հանցագործության պարագայում պետք է ամեն ինչ դիտարկել միջազգային իրավունքի կոնտեքստում: Գյումրիի սպանության գործում ՀՀ օրենսդրության բացարձակ կիրառում չի կարող լինել, որովհետև Հայաստանն ունի միջազգային պայմանագրեր, որոնք մեր օրենսդրության մաս են:
Նա նշեց, որ ՀՀ-ում ռուսական ռազմաբազայի տեղակայման մասին պայմանագրի 4-րդ հոդվածը սահմանում է, որ այն հանցագործությունները, որոնք ռազմաբազայի ծառայողի կողմից կատարվել են ՀՀ տարածքում, իրականացվում է ՀՀ օրենքներով, իսկ նույն պայմանագրի 5-րդ հոդվածը սահմանում է, որ այդ 4-րդ կետի դրույթները կիրառելի չեն այն հանցագործությունների նկատմամբ, որոնք կատարվել են ռազմաբազայի տարածքում, կամ հանցագործությունը կատարվել է ընդդեմ Ռուսաստանի եւ ռազմաբազայի մեջ մտնող անձանց նկատմամբ, կամ եթե կատարվել է զինվորական հանցագործություն: Այսինքն, եթե կատարվել է ռազմական հանցագործություն, ապա այդ դեպքում գործում կիրառելի է ՌԴ օրենսդրությունը:
Գևորգ Կոստանյանն ընդգծեց, որ Գյումրիում հանցագործություն կատարած անձը ծառայությունը ինքնակամ լքելու, պահակակետը թողնելու համար պատասխան է տալու ՌԴ օրենսդրությամբ:
«Փաստորեն կա երկու քրեական գործ, մեկը, որ հարուցվել է ՀՀ իրավապահ մարմինների կողմից ՝ ՀՀ օրենսդրության հիման վրա և քրեական գործ, որը հարուցվել է Ռուսաստանի օրենսդրության հիման վրա՝ Ռուսաստանի իրավապահ մարմինների կողմից: Մենք ունենք իրավազորություն անձի նկատմամբ, քանի որ հանցագործությունը կատարվել է ՀՀ տարածքում, դրա համար հարուցել ենք քրեական գործ համապատասխան հոդվածներով: ՀՀ Քննչական կոմիտեի ղեկավարի տեղակալի մասնակցությունը կտեսնեք քննչական գործողություններին՝ ՀՀ օրենսդրությամբ հարուցված քրգործի շրջանակներում: Տվյալ անձի նկատմամբ գործողություններ են կատարվելու»,-ասաց Կոստանյանը և հավելեց, որ սա այն հարցը չէ, որ պետք է զգացմունքներով առաջնորդվել:
