«Իրազեկ Քաղաքացիների Միավորման» հայտարարություն է տարածել, որում մասնավորապես ասվում է.
«Այսօր Գյումրիում ՀՀ գլխավոր դատախազ Գեւորգ Կոստանյանը հայտարարեց, որ քանի որ ՌԴ զինվորական Վալերի Պերմյակովին մեղսագրվող հանցանքներից առաջինը եղել է զորամասը զենքով լքելը, ուստի հարցը ՌԴ իրավազորության ներքո է:
Պարոն Կոստանյանը նաեւ ընդունեց այն փաստը, որ խնդիրը բարձրացվել է այն բանից հետո, երբ Պերմյակովը հայտնվեց ՌԴ ռազմաբազայում:
Այդ կապակցությամբ հարկ ենք համարում պարզաբանել հետեւյալը`
1. Հանձնման եւ ՌԴ սահմանադրության հետ կապված խնդիրները ի հայտ եկան միայն այն ժամանակ, երբ Պերմյակովը ռուս սահմանապահների կողմից հանձնվեց ՌԴ 102-րդ ռազմաբազայի հրամանատարին: Ռուս Սահմանապահները, սահմանը հատելու փորձ կատարողին որեւէ իրավունք չունեին հանձնելու որեւէ մեկին` բացի ՀՀ իրավապահ մարմիններից:
ՌԴ սահմանապահները խախտել են «Հայաստանի Հանրապետության տարածքում ռուսաստանյան ռազմական բազայի գտնվելու հետ կապված գործերով իրավասության եւ փոխադարձ իրավական օգնության հարցերի մասին» համաձայնագրի 4-րդ հոդվածը, ինչը եւ հանգեցրել է հանձնման հետ կապված բոլոր խնդիրներին:
2. 1999 թվականին, երբ ՌԴ զինվորականներ Դանիս Պոպովն ու Ալեքսանդր Կամենեւը նույն Գյումրիյում զենքով լքեցին զորամասն ու կրակ բացեցին պատահական անցորդների վրա, արդյունքում մահացավ 2 հոգի, 10-ը վիրավորվեցին:
Պոպովին եւ Կամենեւին ձերբակալեցին հայ իրավապահները (ոչ առանց քաղաքացիների օգնության) եւ այդ անձինք դատվեցին Հայաստանի Հանրապետություն` Շիրակի մարզի դատարանում (նախագահությամբ դատավոր Էդվարդ Մանուկյանի):
3. Իրավական տեսանկյունից բացարձակ կարեւոր չէ, թե ո՞ր աշխարհագրական տարածքում է տեղի ունենալու հանցագործության մեղավորի դատը: Կարեւոր է, թե ո՞ր երկրի դատարանն է այն քննելու:
Այս դեպքում, համաձայն Գեւորգ Կոստանյանի, ըստ ամենայնի, Պերմյակովի գործը քննվելու է Գյումրիում ՌԴ կայազորային դատարանը, իսկ գործը վարելու է ՌԴ քննչական կոմիտեի կայազորային 517-րդ քննչական մարմինը:
Վերոնշյալը իրավական հիմք է տալիս պնդելու, որ հարկավոր է, որ Հայաստանի Հանրապետության իրավապահ մարմինները հետաքննություն սկսեն այն փաստի շուրջ, թե ինչու են ռուս սահմանապահները հանցագործին հանձնել ռազմաբազայի հրամանատարին: Ինչպես նաեւ, հարկավոր է քրեական հետապնդման ենթարկել այն սահմանապահներին, ովքեր օգնել են Պերմյակովին խուսափել հայ իրավապահներից:
